Bill Title: Creates the Climate-Safe Affordable Housing Act. Requires the Department of Natural Resources, in consultation with the Illinois Emergency Management Agency, the Illinois Environmental Protection Agency, the Illinois Housing Development Authority, the Department of Commerce and Economic Opportunity, the United States Department of Housing and Urban Development, the Department of Insurance, the Federal Emergency Management Agency, the Metropolitan Water Reclamation District of Greater Chicago, the Illinois State Water Survey of the University of Illinois, and other State, regional, and local storm water management agencies, thought leaders, and interested parties as the Director of Natural Resources deems appropriate, to submit, to the General Assembly and the Governor, a report that reviews and evaluates the latest available information, research, laws, regulations, policies, procedures, and institutional knowledge concerning climate-safe affordable housing. AN ACT concerning housing.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 1. Short title. This Act may be cited as the
Climate-Safe Affordable Housing Act.
Section 5. Definitions. In this Act:
"Affordable housing" has the meaning given in the Illinois
Affordable Housing Act.
"Climate-safe affordable housing" means affordable housing
that is:
(1) constructed to be resistant to the natural hazards
identified in the State natural hazard mitigation plan;
and
(2) not located in an area zoned as a special flood
hazard area, a non-special flood hazard area that is
moderate-to-low risk, an area of undetermined flood
hazard, or an area that is predicted to be located in one
of the aforementioned areas when climate change is
considered.
Section 10. Climate-Safe Affordable Housing Study. By June
30, 2025, the Department of Natural Resources, in consultation
with the Illinois Emergency Management Agency, the Illinois

Environmental Protection Agency, the Illinois Housing
Development Authority, the Department of Commerce and Economic
Opportunity, the United States Department of Housing and Urban
Development, the Department of Insurance, the Federal
Emergency Management Agency, the Metropolitan Water
Reclamation District of Greater Chicago, the Illinois State
Water Survey of the University of Illinois, and other State,
regional, and local storm water management agencies, thought
leaders, and interested parties as the Director of Natural
Resources deems appropriate, shall submit to the General
Assembly and the Governor, a report that reviews and evaluates
the latest available information, research, laws, regulations,
policies, procedures, and institutional knowledge, with
recommendations based on findings in relation to the
following:
(1) the stock and quality of climate-safe affordable
housing, including the amount of affordable housing that
is currently located in flood-prone areas and affordable
housing that may be located in flood-prone areas when
climate change is considered;
(2) the prevalence and costs associated with
displacement due to flooding events across the State, and
the projected trends in frequency and severity of flooding
and displacement caused by flooding over the past 2
decades, with a focus on low-income households and very
low-income households;

(3) the apparent impact of global climate change on
flooding, with a focus on potential permanent or temporary
displacement and climate-safe affordable housing needs
caused by flooding;
(4) the impacts of State and federal buyouts on the
physical, mental, and financial well-being of
participants, and their descendants, over the last 5
decades;
(5) an evaluation of policies that assist or have the
potential to assist displaced people recovering from
flooding events or participating in pre-disaster
mitigation programs, with a focus on low-income households
and very low-income households.
(6) strategies for improving long-term stability and
well-being of people and communities displaced by flooding
events or pre-disaster flood mitigation projects, with a
focus on strategies that can enhance the physical, mental,
and financial well-being of populations that are socially
vulnerable or disadvantaged;
(7) the coordination and consistency of the criteria,
implementation, and accessibility for State funding of
climate-safe affordable housing between the Department of
Natural Resources, Illinois Emergency Management Agency,
Illinois Housing Development Authority, and the Department
of Commerce and Economic opportunity.
Section 99. Effective date. This Act takes effect upon
