1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Counties Code is amended by changing
5Section 3-8017 as follows:
6 (55 ILCS 5/3-8017) (from Ch. 34, par. 3-8017)
7 Sec. 3-8017. Enforcement of orders. If any provision of
8this Division or any order of the the Merit Commission is
9violated by any person, regardless of whether that person's
10employment is under the jurisdiction of the Division, the
11Commission may apply to the circuit court for relief by
12injunction, mandamus or any other proper relief. The State's
13Attorney of the county where the violation occurred shall
14prosecute such action. Whenever the State's Attorney for the
15county where a violation is alleged to have occurred refuses
16to prosecute the action, or fails to begin to prosecute such
17action within 30 days after the date the Commission brings the
18matter to his attention, the Commission may retain special
19counsel of its own choice to prosecute such action.
