1 | AN ACT concerning local government.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Counties Code is amended by changing | |||||||||||||||||||
5 | Section 3-8017 as follows:

7 | Sec. 3-8017. Enforcement of orders. If any provision of | |||||||||||||||||||

Division or any order of the

10 | employment is under the jurisdiction of
the Division, the | |||||||||||||||||||
11 | Commission may apply to the circuit court for relief by

12 | injunction, mandamus or any other proper relief. The State's | |||||||||||||||||||
13 | Attorney of
the county where the violation occurred shall | |||||||||||||||||||
14 | prosecute such action.
Whenever the State's Attorney for the | |||||||||||||||||||
15 | county where a violation is alleged
to have occurred refuses | |||||||||||||||||||
16 | to prosecute the action, or fails to begin to
prosecute such | |||||||||||||||||||
17 | action within 30 days after the date the Commission brings
the | |||||||||||||||||||
18 | matter to his attention, the Commission may retain special | |||||||||||||||||||
19 | counsel of
its own choice to prosecute such action. | |||||||||||||||||||
