Bill Title: Amends the General Not For Profit Corporation Act of 1986. Requires a not-for-profit corporation that is excluded from the definition of "nonprofit organization" under the Unemployment Insurance Act because it does not have in employment 4 or more individuals within each of 20 or more calendar weeks to provide a written notice to each employee and each member of the board of directors that the employees of the not-for-profit corporation are not eligible to receive unemployment insurance benefits on the basis of their employment for the not-for-profit corporation.

| 1 | AN ACT concerning not-for-profit corporations.

| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The General Not For Profit Corporation Act of | ||||||
| 5 | 1986 is amended by adding Section 103.35 as follows:
| ||||||
| 6 | (805 ILCS 105/103.35 new) | ||||||
| 7 | Sec. 103.35. Unemployment insurance; notice. A | ||||||
| 8 | not-for-profit corporation that is excluded from the | ||||||
| 9 | definition of "nonprofit organization" under Section 211.2 of | ||||||
| 10 | the Unemployment Insurance Act because it does not have in | ||||||
| 11 | employment 4 or more individuals within each of 20 or more | ||||||
| 12 | calendar weeks must provide a written notice to each employee, | ||||||
| 13 | either in each employee's employment contract or in a written | ||||||
| 14 | notice provided to employees who do not have employment | ||||||
| 15 | contracts, and to each member of the board of directors that | ||||||
| 16 | the employees of the not-for-profit corporation are not | ||||||
| 17 | eligible to receive unemployment insurance benefits on the | ||||||
| 18 | basis of their employment for the not-for-profit corporation.
