Amends the Public Utilities Act. Provides that a public utility may amortize the cost of installing, replacing, modifying, or maintaining its facilities across all customers in the State if the installation, removal, replacement, modification, or maintenance meets specified requirements. Effective immediately.

1 AN ACT concerning utilities.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Public Utilities Act is amended by adding
5 Section 9-246 as follows:
6 (220 ILCS 5/9-246 new)
7 Sec. 9-246. Amortization over all customers; facilities. A
8 public utility may amortize the cost of installing, replacing,
9 modifying, or maintaining its facilities across all customers
10 in the State if the installation, removal, replacement,
11 modification, or maintenance meets all of the following
12 requirements:
13 (1) the public utility's facility is located in an area
14 designated for economic redevelopment by a unit of local
15 government;
16 (2) the public utility's facility is located in an area
17 subject to tax increment financing;
18 (3) the public utility's facility is in an area that
19 qualifies as a transit-oriented development; and
20 (4) the public utility's facility is located in an area
21 that can be redeveloped in a manner that combats urban
22 sprawl.

1 Section 99. Effective date. This Act takes effect upon
2 becoming law.
