Bill Title: Amends the Early Intervention Services System Act. Requires the Department of Human Services and the Illinois State Board of Education to jointly develop and implement a State policy under which parents of children with disabilities who previously received early intervention services under the Act may choose the continuation of those services until such children reach the age of 5 or enter, or are eligible under State law to enter, kindergarten. Provides that implementation of the new policy shall be contingent on the Department (i) holding public hearings as provided under the Act and (ii) complying with all applicable federal requirements. Effective January 1, 2019.

AN ACT concerning children.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Early Intervention Services System Act is
amended by adding Section 3.5 as follows:
(325 ILCS 20/3.5 new)
Sec. 3.5. Continuation of early intervention services. The
lead agency and the Illinois State Board of Education shall
jointly develop and implement a State policy under which
parents of children with disabilities who are eligible for
services under Part B of the Individuals with Disabilities
Education Act (20 United States Code 1411 through 1419 and as
set forth in 34 CFR 300.115) and who previously received
services under this Act, may choose the continuation of early
intervention services (which shall include an educational
component that promotes school readiness and incorporates
preliteracy, language, and numeracy skills) for such children
under this Act until such children reach the age of 5 or enter,
or are eligible under State law to enter, kindergarten.
Implementation of this Section shall be contingent on the lead
agency holding public hearings on the new policy as provided in
subsection (g) of Section 5 and complying with all federal
requirements in 20 United States Code 1435(c).

Section 99. Effective date. This Act takes effect January
1, 2019.
