Bill Title: Amends the Fish and Aquatic Life Code. Provides that the Department of Natural Resources shall establish an Asian carp pilot program to permit licensed individuals to shoot Asian carp with a shotgun off of a motorboat in the Illinois River beginning with the 2013 licensing year. Provides that the individuals must have the appropriate license and use a specific type of ammunition. Provides that the Department may adopt administrative rules to establish and administer the pilot program.

AN ACT concerning fish.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Fish and Aquatic Life Code is amended by
changing Section 10-80 and by adding Section 10-145 as follows:
(515 ILCS 5/10-80) (from Ch. 56, par. 10-80)
Sec. 10-80. Illegal methods of taking. It shall be unlawful
to take any aquatic life by the use of electricity or any
electrical device; a lime, acid, medical, chemical, or
mechanical compound or dope of any medicated drug; any drug or
any fishberry; any dynamite, giant powder, nitro glycerine, or
other explosives; or by means of a snare, treated grain,
firearms of any kind, except as permitted under Section 10-145
of this Act, air gun or gas gun, wire basket, wire seine, wire
net, wire trotline, or limb lines of any kind.

Sec. 10-145. Asian carp pilot program.
(a) For the purposes of this Section, "motorboat" shall
have the same meaning as in Section 1-2 of the Boat
Registration and Safety Act.
(b) The Department shall establish a pilot program for the

purposes of containing and reducing the invasive aquatic
species commonly referred to as Asian carp in the Illinois
River beginning with the 2013 licensing year.
(c) The Department shall permit the taking of Asian Carp
from motorboats with shotguns if the individual or individuals:
(1) use ammunition described in 50 C.F.R. 20.21(j); and
(2) are in possession of the proper fishing license.
(d) The Department may adopt rules to establish and
administer the Asian carp pilot program.
