Bill Title: Amends the Election Code. Provides that a "candidate political committee", "political action committee", or "ballot initiative committee" means a committee that makes contributions or makes expenditures during any 12-month period in an aggregate amount exceeding $5,000 (now, exceeding $3,000) on behalf of a candidate, on behalf of or in opposition to a candidate, or related to any question of public policy to be submitted to the electors, respectively. Effective July 1, 2012.

| 1 | AN ACT concerning elections.

| 2 | Be it enacted by the People of the State of Illinois,

| 3 | represented in the General Assembly:

| 4 | Section 5. The Election Code is amended by changing Section | |||||||||||||||||||
| 5 | 9-1.8 as follows:

| 7 | Sec. 9-1.8. Political committees. | |||||||||||||||||||
| 8 | (a) "Political committee" includes a candidate political | |||||||||||||||||||
| 9 | committee, a political party committee, a political action | |||||||||||||||||||
| 10 | committee, and a ballot initiative committee. | |||||||||||||||||||
| 11 | (b) "Candidate political committee" means the candidate | |||||||||||||||||||
| 12 | himself or herself or any natural person, trust, partnership, | |||||||||||||||||||
| 13 | corporation, or other organization or group of persons | |||||||||||||||||||
| 14 | designated by the candidate that accepts contributions or makes | |||||||||||||||||||
| 15 | expenditures during any 12-month period in an aggregate amount | |||||||||||||||||||
| 16 | exceeding $5,000 $3,000 on behalf of the candidate. | |||||||||||||||||||
| 17 | (c) "Political party committee" means the State central | |||||||||||||||||||
| 18 | committee of a political party, a county central committee of a | |||||||||||||||||||
| 19 | political party, a legislative caucus committee, or a committee | |||||||||||||||||||
| 20 | formed by a ward or township committeeman of a political party. | |||||||||||||||||||
| 21 | For purposes of this Article, a "legislative caucus committee" | |||||||||||||||||||
| 22 | means a committee established for the purpose of electing | |||||||||||||||||||
| 23 | candidates to the General Assembly by the person elected | |||||||||||||||||||

| 1 | President of the Senate, Minority Leader of the Senate, Speaker | ||||||
| 2 | of the House of Representatives, Minority Leader of the House | ||||||
| 3 | of Representatives, or a committee established by 5 or more | ||||||
| 4 | members of the same caucus of the Senate or 10 or more members | ||||||
| 5 | of the same caucus of the House of Representatives. | ||||||
| 6 | (d) "Political action committee" means any natural person, | ||||||
| 7 | trust, partnership, committee, association, corporation, or | ||||||
| 8 | other organization or group of persons, other than a candidate, | ||||||
| 9 | political party, candidate political committee, or political | ||||||
| 10 | party committee, that accepts contributions or makes | ||||||
| 11 | expenditures during any 12-month period in an aggregate amount | ||||||
| 12 | exceeding $5,000 $3,000 on behalf of or in opposition to a | ||||||
| 13 | candidate or candidates for public office. "Political action | ||||||
| 14 | committee" includes any natural person, trust, partnership, | ||||||
| 15 | committee, association, corporation, or other organization or | ||||||
| 16 | group of persons, other than a candidate, political party, | ||||||
| 17 | candidate political committee, or political party committee, | ||||||
| 18 | that makes electioneering communications during any 12-month | ||||||
| 19 | period in an aggregate amount exceeding $5,000 $3,000 related | ||||||
| 20 | to any candidate or candidates for public office. | ||||||
| 21 | (e) "Ballot initiative committee" means any natural | ||||||
| 22 | person, trust, partnership, committee, association, | ||||||
| 23 | corporation, or other organization or group of persons that | ||||||
| 24 | accepts contributions or makes expenditures during any | ||||||
| 25 | 12-month period in an aggregate amount exceeding $5,000 $3,000 | ||||||
| 26 | in support of or in opposition to any question of public policy | ||||||

| 1 | to be submitted to the electors. "Ballot initiative committee" | ||||||
| 2 | includes any natural person, trust, partnership, committee, | ||||||
| 3 | association, corporation, or other organization or group of | ||||||
| 4 | persons that makes electioneering communications during any | ||||||
| 5 | 12-month period in an aggregate amount exceeding $5,000 $3,000 | ||||||
| 6 | related to any question of public policy to be submitted to the | ||||||
| 7 | voters. The $5,000 $3,000 threshold applies to any | ||||||
| 8 | contributions or expenditures received or made with the purpose | ||||||
| 9 | of securing a place on the ballot for, advocating the defeat or | ||||||
| 10 | passage of, or engaging in electioneering communication | ||||||
| 11 | regarding the question of public policy, regardless of the | ||||||
| 12 | method of initiation of the question of public policy and | ||||||
| 13 | regardless of whether petitions have been circulated or filed | ||||||
| 14 | with the appropriate office or whether the question has been | ||||||
| 15 | adopted and certified by the governing body.

| 17 | Section 99. Effective date. This Act takes effect July 1, | ||||||
| 18 | 2012.
