1 | AN ACT concerning criminal law.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Criminal Code of 1961 is amended by changing | |||||||||||||||||||
5 | Section 20-2 as follows:
| |||||||||||||||||||
6 | (720 ILCS 5/20-2) (from Ch. 38, par. 20-2)

7 | Sec. 20-2. Possession of explosives or explosive or | |||||||||||||||||||
8 | incendiary devices.

9 | (a) A person commits the
the offense of possession of | |||||||||||||||||||
10 | explosives or
explosive or incendiary devices in violation of | |||||||||||||||||||
11 | this Section when he or she
possesses, manufactures or | |||||||||||||||||||
12 | transports
any explosive compound, timing or detonating device | |||||||||||||||||||
13 | for use with any explosive
compound or incendiary device
and | |||||||||||||||||||
14 | either intends to use such explosive or device to commit any | |||||||||||||||||||
15 | offense or
knows that another intends to use such explosive or | |||||||||||||||||||
16 | device to commit a
felony. | |||||||||||||||||||
17 | (b) Sentence.

18 | Possession of explosives or explosive or incendiary | |||||||||||||||||||
19 | devices in violation
of this Section is a Class 1 felony for | |||||||||||||||||||
20 | which a person, if
sentenced to a term of imprisonment, shall | |||||||||||||||||||
21 | be sentenced to not less than 4
years and not more than 30 | |||||||||||||||||||
22 | years.
