1 AN ACT concerning criminal law.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Criminal Code of 1961 is amended by changing
5 Section 20-2 as follows:
6 (720 ILCS 5/20-2) (from Ch. 38, par. 20-2)
7 Sec. 20-2. Possession of explosives or explosive or
8 incendiary devices.
9 (a) A person commits the the offense of possession of
10 explosives or explosive or incendiary devices in violation of
11 this Section when he or she possesses, manufactures or
12 transports any explosive compound, timing or detonating device
13 for use with any explosive compound or incendiary device and
14 either intends to use such explosive or device to commit any
15 offense or knows that another intends to use such explosive or
16 device to commit a felony.
17 (b) Sentence.
18 Possession of explosives or explosive or incendiary
19 devices in violation of this Section is a Class 1 felony for
20 which a person, if sentenced to a term of imprisonment, shall
21 be sentenced to not less than 4 years and not more than 30
22 years.
