1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Energy Efficient Building Act is amended by
5changing Section 10 as follows:
6 (20 ILCS 3125/10)
7 Sec. 10. Definitions.
8 "Agency" means the Environmental Protection Agency.
9 "Board" means the Capital Development Board.
10 "Building" includes both residential buildings and
11commercial buildings.
12 "Code" means the 2021 latest published edition of the
13International Code Council's International Energy Conservation
14Code as adopted by the Board, including any published
15supplements adopted by the Board and any amendments and
16adaptations to the Code that are made by the Board.
17 "Commercial building" means any building except a building
18that is a residential building, as defined in this Section.
19 "Municipality" means any city, village, or incorporated
20town.
21 "Residential building" means (i) a detached one-family or
222-family dwelling or (ii) any building that is 3 stories or
23less in height above grade that contains multiple dwelling

1units, in which the occupants reside on a primarily permanent
2basis, such as a townhouse, a row house, an apartment house, a
3convent, a monastery, a rectory, a fraternity or sorority
4house, a dormitory, and a rooming house; provided, however,
5that when applied to a building located within the boundaries
6of a municipality having a population of 1,000,000 or more,
7the term "residential building" means a building containing
8one or more dwelling units, not exceeding 4 stories above
9grade, where occupants are primarily permanent.
10 "Site energy index" means a scalar published by the
11Pacific Northwest National Laboratories representing the ratio
12of the site energy performance of an evaluated code compared
13to the site energy performance of the 2006 International
14Energy Conservation Code. A "site energy index" includes only
15conservation measures and excludes net energy credit for any
16on-site or off-site energy production.
