AN ACT concerning criminal law.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Controlled Substances Act is
amended by changing Section 407.2 as follows:
(720 ILCS 570/407.2) (from Ch. 56 1/2, par. 1407.2)
Sec. 407.2. Delivery of a controlled substance to a
pregnant woman.
(a) Any person who violates subsection (a) of Section 401
of this Act by delivering a controlled substance to a woman he
knows to be pregnant may be sentenced to imprisonment for a
term twice the the maximum amount authorized by Section 401 of
this Act.
(b) Any person who delivers an amount of a controlled
substance set forth in subsections (c) and (d) of Section 401
of this Act to a woman he knows to be pregnant commits a Class 1
felony. The fine for a violation of this subsection (b) shall
not be more than $250,000.
