| 1 | AN ACT concerning criminal law.

| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly:

| 4 | Section 5. The Illinois Controlled Substances Act is | |||||||||||||||||||
| 5 | amended by changing Section 407.2 as follows:

| 9 | (a) Any person who violates subsection (a) of Section 401 | |||||||||||||||||||

delivering a controlled substance to a woman he | |||||||||||||||||||
| 11 | knows to be pregnant may be
sentenced to imprisonment for a | |||||||||||||||||||
| 12 | term twice the
the maximum amount authorized by
Section 401 of | |||||||||||||||||||
| 13 | this Act. | |||||||||||||||||||
| 14 | (b) Any person who delivers an amount of a controlled | |||||||||||||||||||
| 15 | substance set
forth in subsections (c) and (d) of Section 401 | |||||||||||||||||||
| 16 | of this Act to a woman he
knows to be pregnant commits a Class 1 | |||||||||||||||||||
| 17 | felony. The fine for a violation of
this subsection (b) shall | |||||||||||||||||||
| 18 | not be more than $250,000.
