AN ACT concerning State government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Director of the Department of Natural
Resources, on behalf of the State of Illinois, is authorized to
execute and deliver to Sangamon County, an Illinois unit of
local government, State of Illinois, for and in consideration
of $1 paid to the Department, a quit claim deed to the
following described real property:
All that portion of the right of way and appurtenances of
the abandoned portion of the Madison Subdivision of Union
Pacific Railroad Company (formerly the Chicago and North
Western Transportation Company), now known as the Sangamon
Valley Trail Bikeway, described as Beginning at the North
line of Township 12 North, Range 6 West of the Third
Principal Meridian, and thence running in a northerly
direction along the centerline of said abandoned railroad
to the North line of Section 19, Township 17 North, Range 5
West of the Third Principal Meridian, and also that portion
of the said abandoned railroad within the County of
Sangamon in Sections 6 and 7, Township 17 North, Range 5
West of the Third Principal Meridian and Section 31,
Township 18 North, Range 5 West of the Third Principal
Meridian as measured along said centerline of said
abandoned railroad as originally surveyed, all being
situated in the County of Sangamon and the State of
Illinois. EXCEPTING THEREFROM: All that portion of the
right of way and appurtenances of the abandoned portion of
the Madison Subdivision of Union Pacific Railroad Company
(formerly the Chicago and North Western Transportation
Company), now known as the Sangamon Valley Trail Bikeway,
described as Beginning at the South line of Section 10,
Township 15 North, Range 6 West of the Third Principal
Meridian, and thence running in a northerly direction along
the centerline of said abandoned railroad to a line being
parallel to and 200 feet North of the North line of the
Southwest Quarter of Section 19, Township 16 North, Range 5
West of the Third Principal Meridian, as measured along
said centerline of said abandoned railroad as originally
surveyed, all being situated in the County of Sangamon and
the State of Illinois.
Section 10. The conveyance of real property authorized by
Section 5 shall be made subject to: (1) existing public
utilities, existing public roads, and any and all reservations,
easements, encumbrances, covenants and restrictions of record;
and (2) the express condition that if the real property ceases
to be used for public purposes, it shall revert to the State of
Illinois, Department of Natural Resources.
Section 15. The Director of Natural Resources shall obtain
a certified copy of the portions of this Act containing the
title, the enacting clause, the effective date, the appropriate
Section or Sections containing the land descriptions of the
property to be conveyed, and this Section within 60 days after
its effective date and, upon receipt of the payment required by
the Section or Sections, if any payment is required, shall
record the certified document in the Recorder's Office in the
County in which the land is located.
Section 99. Effective date. This Act takes effect upon
becoming law.
