Bill Title: Amends the Illinois Income Tax Act. Creates a tax checkoff for the Habitat for Humanity Fund. Amends the State Finance Act to create the Fund. Provides that moneys in the Fund shall be appropriated to the Department of Human Services for grants supporting Habitat for Humanity projects in Illinois. Effective immediately.

| 2 | Be it enacted by the People of the State of Illinois,

| 4 | Section 5. The State Finance Act is amended by adding | ||||||||||||||||||||||||||||
| 5 | Sections 5.756 and 6z-76 as follows:

| 7 | Sec. 5.756. The Habitat for Humanity Fund.

| 10 | Habitat for Humanity Fund is created as a special fund in the | ||||||||||||||||||||||||||||
| 11 | State treasury. Moneys in the Fund shall be appropriated to the | ||||||||||||||||||||||||||||
| 12 | Department of Human Services for the purpose of making grants | ||||||||||||||||||||||||||||
| 13 | to Habitat for Humanity of Illinois, Inc., for the purpose of | ||||||||||||||||||||||||||||
| 14 | supporting Habitat for Humanity projects in Illinois.

| 15 | Section 10. The Illinois Income Tax Act is amended by | ||||||||||||||||||||||||||||
| 16 | adding Section 507UU as follows:

| 17 | (35 ILCS 5/507UU new) | ||||||||||||||||||||||||||||
| 18 | Sec. 507UU. Habitat for Humanity fund checkoff. For taxable | ||||||||||||||||||||||||||||
| 19 | years beginning on and after January 1, 2010, the Department
| ||||||||||||||||||||||||||||
| 20 | shall print on
its standard individual income tax form a | ||||||||||||||||||||||||||||
| |||||||
| |||||||
| 1 | provision indicating that if the
taxpayer wishes to contribute | ||||||
| 2 | to the Habitat for Humanity Fund
as authorized by this | ||||||
| 3 | amendatory Act of the 96th General Assembly, he or she may do | ||||||
| 4 | so by stating
the amount of the contribution (not less than $1) | ||||||
| 5 | on the return and that the
contribution will reduce the | ||||||
| 6 | taxpayer's refund or increase the amount of the
payment to | ||||||
| 7 | accompany the return. Failure to remit any amount of increased
| ||||||
| 8 | payment shall reduce the contribution accordingly. This | ||||||
| 9 | Section shall not
apply to an amended return.
| ||||||
| 10 | Section 99. Effective date. This Act takes effect upon | ||||||
| 11 | becoming law.
| ||||||
