Bill Title: Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to incorporate telehealth services in community-integrated living arrangements for individuals with an intellectual and developmental disability for the purpose of providing medical services. Requires the Department to pay the telehealth originating site facility fees for such telehealth services. Provides that the implementation of telehealth services shall not impede the choice of any individual receiving waiver-funded services through the Home and Community-Based Services Waiver Program for Adults with Developmental Disabilities to receive in-person health care services at any time. Provides that the use of telehealth services shall not be used for the convenience of staff at any time. Removes a provision requiring the Department to file an amendment to the Home and Community-Based Services Waiver Program for Adults with Developmental Disabilities to incorporate telehealth services for persons with intellectual and developmental disabilities. Provides that implementation of the amendatory Act is subject to appropriation and federal approval. Effective January 1, 2025.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Public Aid Code is amended by | |||||||||||||||||||
5 | changing Section 5-5a.1 as follows:

6 | (305 ILCS 5/5-5a.1) | |||||||||||||||||||
7 | Sec. 5-5a.1. Telehealth services for individuals persons | |||||||||||||||||||
8 | with intellectual and developmental disabilities. The | |||||||||||||||||||
9 | Department shall incorporate telehealth services in | |||||||||||||||||||
10 | community-integrated living arrangements for individuals with | |||||||||||||||||||
11 | an intellectual and developmental disability for the purpose | |||||||||||||||||||
12 | of providing medical services. The Department shall pay for | |||||||||||||||||||
13 | telehealth originating site facility fees for telehealth | |||||||||||||||||||
14 | services associated with the implementation of this Section. | |||||||||||||||||||
15 | The implementation of telehealth services shall not impede the | |||||||||||||||||||

3 | telehealth services administered by a provider of telehealth | ||||||
4 | services that demonstrates knowledge and experience in | ||||||
5 | providing medical and emergency services for persons with | ||||||
6 | intellectual and developmental disabilities. The Department | ||||||
7 | shall pay administrative fees associated with implementing | ||||||
8 | telehealth services for all persons with intellectual and | ||||||
9 | developmental disabilities who are receiving services under | ||||||
10 | the Home and Community-Based Services Waiver Program for | ||||||
11 | Adults with Developmental Disabilities. | ||||||
