| 1 | AN ACT concerning local government.
| ||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
| 3 | represented in the General Assembly:

| 4 | Section 5. The Local Records Act is amended by adding | ||||||||||||||||||||||||
| 5 | Section 25 as follows:

| 6 | (50 ILCS 205/25 new) | ||||||||||||||||||||||||
| 7 | Sec. 25. Complaints of law enforcement misconduct. A public | ||||||||||||||||||||||||
| 8 | record concerning complaints alleging misconduct by law | ||||||||||||||||||||||||
| 9 | enforcement officers, including, but not limited to, audio | ||||||||||||||||||||||||
| 10 | records, videos, notes, statements, findings of facts, and | ||||||||||||||||||||||||
| 11 | decisions relating to alleged misconduct by law enforcement | ||||||||||||||||||||||||
| 12 | officers shall not be destroyed by the Local Records Commission | ||||||||||||||||||||||||
| 13 | unless the Commission has requested and received approval to | ||||||||||||||||||||||||
| 14 | destroy such public records from the Attorney General. For | ||||||||||||||||||||||||
| 15 | purposes of this section, "law enforcement officer" shall | ||||||||||||||||||||||||
| 16 | include State Police officers and police officers of a unit of | ||||||||||||||||||||||||
| 17 | local government.
