Bill Title: Amends the School Code. With respect to school districts other than the Chicago school district, provides that at least once every 2 years at an in-service training program or at another appropriate time when school personnel are scheduled to be in attendance and in addition to other topics covered at training throughout the school year, school personnel who work with pupils in grades kindergarten through 12 and are employed by the school district shall be trained to identify the warning signs of mental illness and suicidal behavior in youth and shall be taught appropriate intervention and referral techniques (instead of providing that in addition to other topics at in-service training programs, school guidance counselors, teachers, school social workers, and other school personnel who work with pupils in grades 7 through 12 shall be trained to identify the warning signs of mental illness and suicidal behavior in adolescents and teens and shall be taught appropriate intervention and referral techniques). Makes similar changes with respect to the Chicago school district. Effective immediately.

SYNOPSIS AS INTRODUCED:

Amends the School Code. 1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Code is amended by changing Sections
510-22.39 and 34-18.7 as follows:
6 (105 ILCS 5/10-22.39)
7 Sec. 10-22.39. In-service training programs.
8 (a) To conduct in-service training programs for teachers.
9 (b) At least once every 2 years at an in-service training
10program or at another appropriate time when school personnel
11are scheduled to be in attendance and in addition to other
12topics covered at training throughout the school year, In
13addition to other topics at in-service training programs,
14school guidance counselors, teachers, school social workers,
15and other school personnel who work with pupils in grades
16kindergarten 7 through 12 and are employed by the school
17district shall be trained to identify the warning signs of
18mental illness and suicidal behavior in youth adolescents and
19teens and shall be taught appropriate intervention and referral
20techniques.
21 (c) School guidance counselors, nurses, teachers and other
22school personnel who work with pupils may be trained to have a
23basic knowledge of matters relating to acquired

1immunodeficiency syndrome (AIDS), including the nature of the
2disease, its causes and effects, the means of detecting it and
3preventing its transmission, and the availability of
4appropriate sources of counseling and referral, and any other
5information that may be appropriate considering the age and
6grade level of such pupils. The School Board shall supervise
7such training. The State Board of Education and the Department
8of Public Health shall jointly develop standards for such
9training.
10 (d) In this subsection (d):
11 "Domestic violence" means abuse by a family or household
12member, as "abuse" and "family or household members" are
13defined in Section 103 of the Illinois Domestic Violence Act of
141986.
15 "Sexual violence" means sexual assault, abuse, or stalking
16of an adult or minor child proscribed in the Criminal Code of
171961 or the Criminal Code of 2012 in Sections 11-1.20, 11-1.30,
1811-1.40, 11-1.50, 11-1.60, 12-7.3, 12-7.4, 12-7.5, 12-12,
1912-13, 12-14, 12-14.1, 12-15, and 12-16, including sexual
20violence committed by perpetrators who are strangers to the
21victim and sexual violence committed by perpetrators who are
22known or related by blood or marriage to the victim.
23 At least once every 2 years, an in-service training program
24for school personnel who work with pupils, including, but not
25limited to, school and school district administrators,
26teachers, school guidance counselors, school social workers,

1school counselors, school psychologists, and school nurses,
2must be conducted by persons with expertise in domestic and
3sexual violence and the needs of expectant and parenting youth
4and shall include training concerning (i) communicating with
5and listening to youth victims of domestic or sexual violence
6and expectant and parenting youth, (ii) connecting youth
7victims of domestic or sexual violence and expectant and
8parenting youth to appropriate in-school services and other
9agencies, programs, and services as needed, and (iii)
10implementing the school district's policies, procedures, and
11protocols with regard to such youth, including
12confidentiality. At a minimum, school personnel must be trained
13to understand, provide information and referrals, and address
14issues pertaining to youth who are parents, expectant parents,
15or victims of domestic or sexual violence.
16 (e) At least every 2 years, an in-service training program
17for school personnel who work with pupils must be conducted by
18persons with expertise in anaphylactic reactions and
19management.
20 (f) At least once every 2 years, a school board shall
21conduct in-service training on educator ethics,
22teacher-student conduct, and school employee-student conduct
23for all personnel.

1 Sec. 34-18.7. Youth Adolescent and teen mental illness and
2suicide detection and intervention. School guidance
3counselors, teachers, school social workers, and other school
4personnel who work with pupils in grades kindergarten 7 through
512 shall be trained at least once every 2 years to identify the
6warning signs of mental illness and suicidal behavior in youth
7adolescents and teens and shall be taught various intervention
8techniques. Such training shall be provided (i) within the
9framework of existing in-service training programs offered by
10the Board, (ii) or as part of the professional development
11activities required under Section 21-14 of this Code, or (iii)
12at another appropriate time when school personnel are scheduled
13to be in attendance.

15 Section 99. Effective date. This Act takes effect upon
16becoming law.
