Bill Title: Refers to the amendatory Act as Marlen's Law. Amends the University of Illinois Hospital Act and the Hospital Licensing Act. Requires hospitals organized or licensed under the Acts to make reasonable efforts to verify that when an infant who is less than 3 months of age is admitted to such a hospital with visible signs of abuse or neglect and was not born at the hospital at least one individual accompanying the infant is the infant's parent or guardian or permitted by the infant's parent or guardian to accompany the infant. Provides that if the hospital is unable to make such a verification, then each individual accompanying the infant must provide a sample of his or her DNA and information sufficient to identify the individual, which shall be kept on file at the hospital. Effective immediately.

| 1 | AN ACT concerning health.

| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||||
| 4 | Section 1. Short title. This Act may be referred to as the | |||||||||||||||||||||
| 5 | Marlen's Law.
| |||||||||||||||||||||
| 6 | Section 5. The University of Illinois Hospital Act is | |||||||||||||||||||||
| 7 | amended by adding Section 8d as follows:
| |||||||||||||||||||||
| 8 | (110 ILCS 330/8d new) | |||||||||||||||||||||
| 9 | Sec. 8d. Identification of individual accompanying an | |||||||||||||||||||||
| 10 | infant. | |||||||||||||||||||||
| 11 | (a) If an infant who is less than 3 months of age is | |||||||||||||||||||||
| 12 | admitted to the University of Illinois Hospital with visible | |||||||||||||||||||||
| 13 | signs of abuse or neglect and the infant was not born at the | |||||||||||||||||||||
| 14 | University of Illinois Hospital, the University of Illinois | |||||||||||||||||||||
| 15 | Hospital shall make reasonable efforts to verify that at least | |||||||||||||||||||||
| 16 | one individual accompanying the infant is the infant's parent | |||||||||||||||||||||
| 17 | or guardian or permitted by the infant's parent or guardian to | |||||||||||||||||||||
| 18 | accompany the infant. | |||||||||||||||||||||
| 19 | (b) If the University of Illinois Hospital is unable to | |||||||||||||||||||||
| 20 | make the verification required under subsection (a), then each | |||||||||||||||||||||
| 21 | individual accompanying the infant must provide the following, | |||||||||||||||||||||
| 22 | which shall be kept on file at the University of Illinois | |||||||||||||||||||||

| 1 | Hospital: | ||||||
| 2 | (1) a sample of his or her DNA; and | ||||||
| 3 | (2) information sufficient to identify the individual.

| 4 | Section 10. The Hospital Licensing Act is amended by adding | ||||||
| 5 | Section 6.15a as follows:
| ||||||
| 6 | (210 ILCS 85/6.15a new) | ||||||
| 7 | Sec. 6.15a. Identification of individual accompanying an | ||||||
| 8 | infant. | ||||||
| 9 | (a) If an infant who is less than 3 months of age is | ||||||
| 10 | admitted to a hospital licensed under this Act with visible | ||||||
| 11 | signs of abuse or neglect and was not born at the hospital, the | ||||||
| 12 | hospital shall make reasonable efforts to verify that at least | ||||||
| 13 | one individual accompanying the infant is the infant's parent | ||||||
| 14 | or guardian or permitted by the infant's parent or guardian to | ||||||
| 15 | accompany the infant. | ||||||
| 16 | (b) If the hospital is unable to make the verification | ||||||
| 17 | required under subsection (a), then each individual | ||||||
| 18 | accompanying the infant must provide the following, which shall | ||||||
| 19 | be kept on file at the hospital: | ||||||
| 20 | (1) a sample of his or her DNA; and | ||||||
| 21 | (2) information sufficient to identify the individual.

| 22 | Section 99. Effective date. This Act takes effect upon | ||||||
| 23 | becoming law.
