Bill Title: Amends the Illinois State Police Law. Provides that, if a noncitizen is convicted of a crime that results in death or great bodily harm, then the Illinois State Police shall deport the noncitizen to the noncitizen's country of origin after the noncitizen is released from a term of incarceration, unless the Illinois State Police cannot determine the noncitizen's country of origin. Provides that, if the Illinois State Police cannot determine the noncitizen's country of origin, then the Illinois State Police shall deport the noncitizen to the noncitizen's country of entry. Provides that, if the noncitizen was not sentenced to a term of incarceration, then the Illinois State Police shall deport the noncitizen after the noncitizen is sentenced. Defines "country of entry" and "country of origin". Amends the Illinois Administrative Procedure Act. Grants the Illinois State Police emergency rulemaking powers. Effective immediately.

| 1 | AN ACT concerning State government. | |||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||||
| 4 | Section 1. This Act shall be known as Katie's Law. | |||||||||||||||||||||
| 5 | Section 3. Findings. The General Assembly finds that: | |||||||||||||||||||||
| 6 | (1) illegal immigration is a danger to the citizens of | |||||||||||||||||||||
| 7 | this State; | |||||||||||||||||||||
| 8 | (2) illegal immigrants have committed violent acts | |||||||||||||||||||||
| 9 | against American citizens, engaged in hostile activities, | |||||||||||||||||||||
| 10 | and have abused and illicitly benefited from systems | |||||||||||||||||||||
| 11 | created to protect citizens of this State; | |||||||||||||||||||||
| 12 | (3) this State's sanctuary state policies: | |||||||||||||||||||||
| 13 | (A) protect those here illegally; | |||||||||||||||||||||
| 14 | (B) harm communities; and | |||||||||||||||||||||
| 15 | (C) fail the citizens of this State; | |||||||||||||||||||||
| 16 | (4) 20-year-old Katie Abraham was killed in January | |||||||||||||||||||||
| 17 | 2025 in a hit-and-run car crash caused by an illegal | |||||||||||||||||||||
| 18 | immigrant; | |||||||||||||||||||||
| 19 | (5) enforcing federal immigration laws is vitally | |||||||||||||||||||||
| 20 | important for public safety; and | |||||||||||||||||||||
| 21 | (6) this State needs to act to protect its citizens. | |||||||||||||||||||||
| 22 | Section 5. The Illinois Administrative Procedure Act is | |||||||||||||||||||||

| 1 | amended by adding Section 5-45.69 as follows: | ||||||
| 2 | (5 ILCS 100/5-45.69 new) | ||||||
| 3 | Sec. 5-45.69. Emergency rulemaking; Illinois State Police. | ||||||
| 4 | To provide for the expeditious and timely implementation of | ||||||
| 5 | this amendatory Act of the 104th General Assembly, emergency | ||||||
| 6 | rules implementing the changes made to the Illinois State | ||||||
| 7 | Police Law by this amendatory Act of the 104th General | ||||||
| 8 | Assembly may be adopted in accordance with Section 5-45 by the | ||||||
| 9 | Illinois State Police. The adoption of emergency rules | ||||||
| 10 | authorized by Section 5-45 and this Section is deemed to be | ||||||
| 11 | necessary for the public interest, safety, and welfare. This | ||||||
| 12 | Section is repealed one year after the effective date of this | ||||||
| 13 | amendatory Act of the 104th General Assembly. | ||||||
| 14 | Section 10. The Illinois State Police Law of the Civil | ||||||
| 15 | Administrative Code of Illinois is amended by adding Section | ||||||
| 16 | 2605-640 as follows: | ||||||
| 17 | (20 ILCS 2605/2605-640 new) | ||||||
| 18 | Sec. 2605-640. Deportation of criminal noncitizens. | ||||||
| 19 | (a) As used in this Section: | ||||||
| 20 | "Country of entry" means a country by which a noncitizen | ||||||
| 21 | gains entry into the United States of America. | ||||||
| 22 | "Country of origin" means a country of which a noncitizen | ||||||
| 23 | is a citizen. | ||||||

| 1 | (b) Notwithstanding any law to the contrary, if a | ||||||
| 2 | noncitizen is convicted of a crime that results in death or | ||||||
| 3 | great bodily harm, then the Illinois State Police shall deport | ||||||
| 4 | the noncitizen to the noncitizen's country of origin after the | ||||||
| 5 | noncitizen is released from a term of incarceration, unless | ||||||
| 6 | the Illinois State Police cannot determine the noncitizen's | ||||||
| 7 | country of origin. If the Illinois State Police cannot | ||||||
| 8 | determine the noncitizen's country of origin, then the | ||||||
| 9 | Illinois State Police shall deport the noncitizen to the | ||||||
| 10 | noncitizen's country of entry. If the noncitizen was not | ||||||
| 11 | sentenced to a term of incarceration, then the Illinois State | ||||||
| 12 | Police shall deport the noncitizen after the noncitizen is | ||||||
| 13 | sentenced. | ||||||
| 14 | (c) The Illinois State Police shall adopt rules to enforce | ||||||
| 15 | this Section. | ||||||
| 16 | Section 99. Effective date. This Act takes effect upon | ||||||
| 17 | becoming law. | ||||||
