AN ACT concerning State government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Department of Public Health Powers and
Duties Law of the Civil Administrative Code of Illinois is
amended by adding Section 2310-685 as follows:
(20 ILCS 2310/2310-685 new)
Sec. 2310-685. Cytomegalovirus public education program.
(a) In this Section:
"CMV" means cytomegalovirus.
"Health care provider" means any physician, hospital
facility, or other person that is licensed or otherwise
authorized to deliver health care services.
(b) The Department shall establish and conduct a public
education program to inform pregnant women and women who may
become pregnant regarding:
(1) incidences of CMV;
(2) the transmission of CMV to pregnant women and women
who may become pregnant;
(3) birth defects caused by congenital CMV;
(4) methods of diagnosing congenital CMV; and
(5) available preventative measures.
(c) The Department shall provide the information described

in subsection (b) of this Section to the following entities:
(1) child care programs licensed under the Child Care
Act of 1969;
(2) any person serving as a school nurse;
(3) any person offering health education in a school
district;
(4) health care providers offering care to pregnant
women and infants; and
(5) religious, ecclesiastical, or denominational
organizations offering children's programs as a part of
worship services.
(d) If a newborn infant fails a newborn hearing screening,
then the treating health care provider shall:
(1) test the newborn infant or refer the newborn infant
for testing for CMV before the newborn is 21 days of age,
unless a parent of the newborn infant objects; and
(2) provide to the parents of the newborn infant
information regarding (i) birth defects caused by
congenital CMV and (ii) available methods of treatment.
(e) The Department shall adopt rules necessary to implement
this Section.
