| 1 | AN ACT concerning State government.
| ||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
| 3 | represented in the General Assembly:
| ||||||||||||||||||||||||
| 4 | Section 5. The Department of Public Health Powers and | ||||||||||||||||||||||||
| 5 | Duties Law of the
Civil Administrative Code of Illinois is | ||||||||||||||||||||||||
| 6 | amended by adding Section 2310-685 as follows:
| ||||||||||||||||||||||||
| 7 | (20 ILCS 2310/2310-685 new) | ||||||||||||||||||||||||
| 8 | Sec. 2310-685. Cytomegalovirus public education program. | ||||||||||||||||||||||||
| 9 | (a) In this Section: | ||||||||||||||||||||||||
| 10 | "CMV" means cytomegalovirus. | ||||||||||||||||||||||||
| 11 | "Health care provider" means any physician, hospital | ||||||||||||||||||||||||
| 12 | facility, or other
person that is licensed or otherwise | ||||||||||||||||||||||||
| 13 | authorized to deliver health care
services. | ||||||||||||||||||||||||
| 14 | (b) The Department shall establish and conduct a public | ||||||||||||||||||||||||
| 15 | education program to inform
pregnant women and women who may | ||||||||||||||||||||||||
| 16 | become pregnant regarding: | ||||||||||||||||||||||||
| 17 | (1) incidences of CMV; | ||||||||||||||||||||||||
| 18 | (2) the transmission of CMV to pregnant women and women | ||||||||||||||||||||||||
| 19 | who may become
pregnant; | ||||||||||||||||||||||||
| 20 | (3) birth defects caused by congenital CMV; | ||||||||||||||||||||||||
| 21 | (4) methods of diagnosing congenital CMV; and | ||||||||||||||||||||||||
| 22 | (5) available preventative measures. | ||||||||||||||||||||||||
| 23 | (c) The Department shall provide the information described | ||||||||||||||||||||||||

| |||||||
| 1 | in subsection (b) of this Section to the following entities: | ||||||
| 2 | (1) child care programs licensed under the Child Care | ||||||
| 3 | Act of 1969; | ||||||
| 4 | (2) any person serving as a school nurse; | ||||||
| 5 | (3) any person offering health education in a school | ||||||
| 6 | district; | ||||||
| 7 | (4) health care providers offering care to pregnant | ||||||
| 8 | women and infants; and | ||||||
| 9 | (5) religious, ecclesiastical, or denominational | ||||||
| 10 | organizations offering children's
programs as a part of | ||||||
| 11 | worship services. | ||||||
| 12 | (d) If a newborn infant fails a newborn hearing screening, | ||||||
| 13 | then the treating health care provider shall: | ||||||
| 14 | (1) test the newborn infant or refer the newborn infant | ||||||
| 15 | for testing for CMV before the newborn is 21 days of age, | ||||||
| 16 | unless a
parent of the newborn infant objects; and | ||||||
| 17 | (2) provide to the parents of the newborn infant | ||||||
| 18 | information regarding (i) birth defects caused by | ||||||
| 19 | congenital CMV and (ii) available methods of treatment. | ||||||
| 20 | (e) The Department shall adopt rules necessary to implement | ||||||
| 21 | this Section.
