Bill Title: Amends the School Code. Provides that a school board or the governing board of a nonpublic school has the authority to determine, in consultation with the local health department, whether to implement mask-wearing requirements for school staff, students, and visitors when the Governor has declared a disaster due to a public health emergency related to COVID-19. Effective immediately.

AN ACT concerning education.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The School Code is amended by adding Sections
10-20.76, 22-91, and 34-18.70 as follows:

Sec. 10-20.76. COVID-19 mask-wearing requirements.
Notwithstanding any other law or rule to the contrary, when
the Governor has declared a disaster due to a public health
emergency related to COVID-19 pursuant to Section 7 of the
Illinois Emergency Management Agency Act, the school board of
a school district serving any of grades pre-kindergarten
through 12 shall have the authority to determine, in
consultation with the local department of public health,
whether to implement mask-wearing requirements for school
staff, students, and visitors.

Sec. 22-91. COVID-19 mask-wearing requirements.

Illinois Emergency Management Agency Act, the board of a
school district serving any of grades pre-kindergarten through
12 shall have the authority to determine, in consultation with

mask-wearing requirements for school staff, students, and
visitors.
Section 99. Effective date. This Act takes effect upon
becoming law.
