Bill Title: Amends the Governor's Office of Management and Budget Act. Provides that requests for federal funding by State agencies shall be filed with the Governor's Office of Management and Budget, and posted on the Office's website for public comment, at least 30 days prior to making the request for funding to the federal government. Provides that requests for federal funding by State agencies exceeding $250,000 in a fiscal year shall be filed with the Joint Committee on Federal Funding Requests. Creates the Joint Committee on Federal Funding Requests. Provides that requests for federal funding that have not been filed with the Governor's Office of Management and Budget, or approved by a majority vote of the Joint Committee on Federal Funding Requests, as applicable, shall be void and any funds received shall be returned to the federal government. Effective July 1, 2015.

1 | AN ACT concerning State government.
| ||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Governor's Office of Management and Budget | ||||||||||||||||||||||||
5 | Act is amended by adding Section 5.2 as follows:

6 | (20 ILCS 3005/5.2 new) | ||||||||||||||||||||||||
7 | Sec. 5.2. Federal funding requests. | ||||||||||||||||||||||||
8 | (a) In addition to the requirements of Section 5.1, and | ||||||||||||||||||||||||
9 | under such regulations as the Governor may prescribe, every | ||||||||||||||||||||||||
10 | State agency, other than State colleges and universities, | ||||||||||||||||||||||||
11 | agencies of legislative and judicial branches of State | ||||||||||||||||||||||||
12 | government, and elected State executive officers not including | ||||||||||||||||||||||||
13 | the Governor, shall file with the Governor's Office of | ||||||||||||||||||||||||
14 | Management and Budget all requests for federal funding by that | ||||||||||||||||||||||||
15 | agency for new or continued projects or maintenance of federal | ||||||||||||||||||||||||
16 | projects. Requests shall be filed and posted on the website of | ||||||||||||||||||||||||
17 | the Governor's Office of Management and Budget not less than 30 | ||||||||||||||||||||||||
18 | days prior to the official request for funds to the federal | ||||||||||||||||||||||||
19 | government to allow for public comment. | ||||||||||||||||||||||||
20 | Each request for federal funding received by the Governor's | ||||||||||||||||||||||||
21 | Office of Management and Budget shall be assigned a unique | ||||||||||||||||||||||||
22 | identification number by the Office, to allow for tracking of | ||||||||||||||||||||||||
23 | the request together with any related projects and funding. |

1 | Any request for federal funding subject to the requirements | ||||||
2 | of this subsection which has not been filed with the Governor's | ||||||
3 | Office of Management and Budget shall be void, and any funds | ||||||
4 | received shall be returned to the federal government before | ||||||
5 | they are spent. | ||||||
6 | (b) In addition to the requirements of subsection (a), all | ||||||
7 | requests that exceed $250,000 within a fiscal year must be | ||||||
8 | submitted to the Joint Committee on Federal Funding Requests | ||||||
9 | for its approval not less than 30 days prior to the official | ||||||
10 | request of funds to the federal government. A report prepared | ||||||
11 | by the State agency showing liability to the State, if any, | ||||||
12 | created by the funding request must be submitted to the Joint | ||||||
13 | Committee together with the funding request. | ||||||
14 | Any request for federal funding subject to the requirements | ||||||
15 | of this subsection (b) which has not been approved by the Joint | ||||||
16 | Committee on Federal Funding Requests shall be void, and any | ||||||
17 | funds received shall be returned to the federal government | ||||||
18 | before they are spent. | ||||||
19 | (c) There is created the Joint Committee on Federal Funding | ||||||
20 | Requests, comprised of 12 members of the General Assembly | ||||||
21 | appointed as follows: 3 by the Speaker of the House of | ||||||
22 | Representatives, one of whom shall serve as co-chair; 3 by the | ||||||
23 | Minority Leader of the House of Representatives; 3 by the | ||||||
24 | President of the Senate, one of whom shall serve as co-chair; | ||||||
25 | and 3 by the Minority Leader of the Senate. The Joint Committee | ||||||
26 | shall by majority vote approve or deny each request for federal |

1 | funding submitted to it. If no vote is taken upon a request for | ||||||
2 | federal funding within 90 calendar days from its receipt by the | ||||||
3 | Joint Committee, that request shall be considered to have been | ||||||
4 | approved by the Joint Committee.

5 | Section 99. Effective date. This Act takes effect July 1, | ||||||
6 | 2015.
