Bill Title: Amends the Counties Code. Requires the county board of Cook County to appoint an independent county personnel director. Provides that, through December 31, 2011, the independent personnel director shall appoint all officers and employees of Cook County and shall assume the duties of the county civil service commission. Requires the civil service commission to perform duties and functions as directed by the independent personnel director and to otherwise operate in an advisory capacity to the director. Effective immediately.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Counties Code is amended by changing Section
5 3-14001 and by adding Section 3-14010.5 as follows:
6 (55 ILCS 5/3-14001) (from Ch. 34, par. 3-14001)
7 Sec. 3-14001. Appointment of officers and employees;
8 salaries and bond. Except as provided in Section 3-14010.5, all
9 All officers and employees of the county of Cook, in the
10 classification hereinafter provided for, except those whose
11 election or appointment is otherwise provided for by law, and
12 except those enumerated in Section 3-14022, shall be appointed
13 by the president of the board, according to the provisions of
14 this Section. The salaries or rate of compensation of all
15 officers and employees of said county, when not otherwise
16 provided by law, shall be fixed by the board of commissioners
17 and shall be fixed prior to the adoption of the annual
18 appropriation, and shall not be changed during the year for
19 which the appropriation is made. The board of commissioners
20 shall also determine whether any or what amount of bond any
21 officer or employee shall give.

2 Sec. 3-14010.5. Independent Personnel Director.
3 (a) Within 30 days after the effective date of this
4 amendatory Act of the 96th General Assembly, the county board
5 shall appoint an independent county personnel director. The
6 Director must be appointed by the affirmative vote of at least
7 three-fifths of the commissioners holding office. The
8 independent personnel director may not hold any other lucrative
9 office or employment under the United States, the State of
10 Illinois, or any municipal corporation or political division
11 thereof. The independent personnel director, before entering
12 upon the duties of the office, shall take the oath prescribed
13 by the Constitution of this State.
14 (b) Through December 31, 2011, the independent personnel
15 director shall appoint all officers and employees of the county
16 of Cook, except those whose election or appointment is
17 otherwise provided for by law, and except those enumerated in
18 Section 3-14022.
19 (c) Through December 31, 2011, the independent personnel
20 director shall assume the duties of the civil service
21 commission under this Division 3-14. The civil service
22 commission shall perform the duties and functions as directed
23 by the independent personnel director and shall otherwise
24 operate in an advisory capacity to the director through
25 December 31, 2011.
26 Section 99. Effective date. This Act takes effect upon
