Bill Title: Amends the Park District Police Act. Provides that a park district may employ auxiliary police officers and use auxiliary police officers when it is impractical for members of the regular park district police force to perform their normal and regular police duties. Provides that the auxiliary officers may not carry firearms without permission of the chief of police. Provides for hiring and training requirements for the auxiliary officers. Further provides that the Line of Duty Compensation Act shall be applicable to auxiliary officers upon their death in the line of duty. Effective immediately.

| 1 | AN ACT concerning local government.
| |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||
| 4 | Section 5. The Park District Police Act is amended by | |||||||||||||||||||
| 5 | adding Section 5 as follows:
| |||||||||||||||||||
| 6 | (70 ILCS 1325/5 new) | |||||||||||||||||||
| 7 | Sec. 5. Auxiliary police officers. | |||||||||||||||||||
| 8 | (a) Auxiliary police officers shall
not be members of the | |||||||||||||||||||
| 9 | police force of the park district.
Auxiliary police officers | |||||||||||||||||||
| 10 | shall not supplement members of the regular
police force of any | |||||||||||||||||||
| 11 | park district in the performance of their
assigned and normal | |||||||||||||||||||
| 12 | duties, except as otherwise provided in this Code.
When it is | |||||||||||||||||||
| 13 | impractical for members of the regular
police force to perform | |||||||||||||||||||
| 14 | normal and regular police duties,
the
chief of police of the | |||||||||||||||||||
| 15 | regular police force may
assign auxiliary police officers to | |||||||||||||||||||
| 16 | perform those normal and regular police
duties. Identification | |||||||||||||||||||
| 17 | symbols worn by auxiliary police officers shall be
different | |||||||||||||||||||
| 18 | and distinct from those used by members of the regular police
| |||||||||||||||||||
| 19 | force. Auxiliary police officers shall at all times during the
| |||||||||||||||||||
| 20 | performance of their duties be subject to the direction and | |||||||||||||||||||
| 21 | control of
the chief of police of the park district. Auxiliary | |||||||||||||||||||
| 22 | police officers
shall not carry firearms, except with the | |||||||||||||||||||
| 23 | permission of the chief of
police and while in uniform and in | |||||||||||||||||||
| |||||||
| |||||||
| 1 | the performance of their duties.
Auxiliary police officers, | ||||||
| 2 | when on duty, shall also be conservators of the
peace and shall | ||||||
| 3 | have the powers specified in Section 3.1-15-25 of the Illinois | ||||||
| 4 | Municipal Code. | ||||||
| 5 | (b) Auxiliary police officers, before entering upon any of | ||||||
| 6 | their duties,
shall receive a course of training in the use of | ||||||
| 7 | weapons and other
police procedures appropriate for the | ||||||
| 8 | exercise of the powers
conferred upon them. The training and | ||||||
| 9 | course of study
shall be determined and provided by the | ||||||
| 10 | corporate authorities of each
park district employing | ||||||
| 11 | auxiliary police officers. Before being permitted to carry a | ||||||
| 12 | firearm, however, an auxiliary police officer must have the | ||||||
| 13 | same course of training as required of peace officers under | ||||||
| 14 | Section 2 of the Peace Officer and Probation Officer Firearm | ||||||
| 15 | Training Act. The park district authorities may
require that | ||||||
| 16 | all auxiliary police officers be residents of a municipality
| ||||||
| 17 | near the park district. Before the appointment of an auxiliary | ||||||
| 18 | police officer, the
person's fingerprints shall be taken, and | ||||||
| 19 | no person shall be appointed as an
auxiliary police officer if | ||||||
| 20 | that person has been convicted of a felony or other
crime
| ||||||
| 21 | involving moral turpitude. | ||||||
| 22 | (c) The Line of Duty Compensation Act
shall be applicable | ||||||
| 23 | to auxiliary police officers
upon their death in the line of | ||||||
| 24 | duty described in subsection (e) of Section 2 of that Act.
| ||||||
| 25 | Section 99. Effective date. This Act takes effect upon | ||||||
| 26 | becoming law.
