AN ACT concerning safety.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Public Water Supply Regulation Act is
amended by adding Section 14a as follows:
(415 ILCS 40/14a new)
Sec. 14a. Sale of water resources.
(a) Notwithstanding any other provision of law, on and
after this effective date of this amendatory Act of the 102nd
General Assembly, the State or a unit of local government may
not contract for the sale or lease of water resources for a
period longer than 4 years, inclusive of extensions or
renewals of the contract.
(b) A home rule unit may not regulate the sale of water
resources in a manner inconsistent with this Section. This
Section is a limitation under subsection (i) of Section 6 of
Article VII of the Illinois Constitution on the concurrent
exercise by home rule units of powers and functions exercised
by the State.
