Bill Title: Amends the Illinois Vehicle Code. Provides that the Department of Transportation may erect and maintain signs prohibiting excessive engine braking noise on interstate highways when multiple residences are immediately adjacent to the highway at a density of 2 per acre or more. Merges a provision of the Illinois Vehicle Code prohibiting a person from operating any motor vehicle in such a manner as to cause or allow to be emitted squealing, screeching or other such noise from the vehicle's tires due to rapid acceleration or excessive speed around corners or other such reason into another provision of the Illinois Vehicle Code prohibiting the driver of a commercial vehicle from operating or actuating any engine braking system that emits excessive noise.

1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by changing
5 Section 12-602.1 as follows:
6 (625 ILCS 5/12-602.1)
7 Sec. 12-602.1. Excessive engine braking noise signs.
8 (a) A county or municipality may post signs that prohibit
9 the driver of a commercial vehicle, as defined in Section
10 1-111.8 of this Code, from operating or actuating any engine
11 braking system that emits excessive noise. The Department of
12 Transportation may erect and maintain the signs on interstate
13 highways near weigh stations that are adjacent to residential
14 areas or communities.
15 (b) The sign shall state, "EXCESSIVE ENGINE BRAKING NOISE
16 PROHIBITED". The Department of Transportation shall adopt
17 rules providing for the erection and placement of these signs.
18 (c) This Section does not apply to the use of an engine
19 braking system that has an adequate sound muffling system in
20 proper working order that prevents excessive noise.
21 (d) It is a defense to this Section that the driver used an
22 engine braking system that emits excessive noise in an
23 emergency to avoid a collision with a person or another vehicle

2 (e) A violation of this Section is an equipment violation
3 punishable by a fine of $75.
