Bill Title: Amends the Illinois Public Aid Code. Creates the Cross-Agency Medicaid Recoupment Commission, composed of representatives from the departments of Healthcare and Family Services, Human Services, and Children and Family Services and the State Board of Education and representatives of vendors of goods or services to individuals or families who are (i) eligible for medical assistance under the Code or (ii) eligible for other benefits under any other program administered by those agencies. Provides that the Commission shall study ways for the 4 agencies to coordinate their activities and programs to maximize the amount of federal Medicaid matching funds paid to the State for goods and services provided to individuals and families under programs administered by those 4 agencies. Requires the Commission to report its findings and recommendations to the General Assembly by January 1, 2010. Effective immediately.

1 AN ACT concerning public aid.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5 adding Section 12-4.7e as follows:
6 (305 ILCS 5/12-4.7e new)
7 Sec. 12-4.7e. Cross-Agency Medicaid Commission.
8 (a) The Cross-Agency Medicaid Commission is established to
9 study ways for the State agencies named in paragraphs (1)
10 through (4) of subsection (b) to coordinate activities and
11 programs to maximize the amount of federal Medicaid matching
12 funds paid to the State for goods and services provided to
13 children and their families under programs administered by
14 those agencies.
15 (b) The Commission shall consist of the following 8
16 members:
17 (1) The Director of Healthcare and Family Services or
18 his or her designee; and a representative of vendors of
19 goods or services to children or their families who are
20 eligible for medical assistance under Article V of this
21 Code or for benefits under any other program administered
22 by the Department of Healthcare and Family Services for
23 which federal Medicaid matching funds may be available.

1 (2) The Secretary of Human Services or his or her
2 designee; and a representative of vendors of goods or
3 services to children or their families who are eligible for
4 benefits under any program administered by the Department
5 of Human Services for which federal Medicaid matching funds
6 may be available.
7 (3) The Director of Children and Family Services or his
8 or her designee; and a representative of vendors of goods
9 or services to children or their families who are eligible
10 for benefits under any program administered by the
11 Department of Children and Family Services for which
12 federal Medicaid matching funds may be available.
13 (4) The State Superintendent of Education or his or her
14 designee; and a representative of vendors of goods or
15 services to children or their families who are eligible for
16 benefits under any program administered by the Illinois
17 State Board of Education for which federal Medicaid
18 matching funds may be available.
19 (c) The Director of Healthcare and Family Services shall
20 serve as the Chair of the Commission. All members other than
21 representatives of State agencies shall be appointed by the
22 Governor no later than January 1, 2010 and shall serve without
23 compensation. A quorum shall consist of 5 members. An
24 affirmative vote of a majority of those members present and
25 voting shall be necessary for Commission action. The Commission
26 shall meet quarterly or more frequently at the call of the

1 Chair.
2 (d) The Department of Human Services shall provide staff
3 and support to the Commission.
4 (e) The Commission may release findings and
5 recommendations at any time but at a minimum must observe the
6 following schedule:
7 (1) The Commission must issue preliminary findings and
8 recommendations to the General Assembly by July 1, 2010.
9 (2) The Commission must issue its final findings and
10 recommendations to the General Assembly by December 31,
11 2011.
12 (f) This Section is repealed on January 1, 2012.
13 Section 99. Effective date. This Act takes effect upon
14 becoming law.
