AN ACT concerning temporary stormwater storage.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Municipal Code is amended by
adding Section 11-13-30 as follows:
(65 ILCS 5/11-13-30 new)
Sec. 11-13-30. Temporary stormwater storage.
Notwithstanding any provision of law to the contrary, the use
of open space for temporary stormwater storage is allowed and
does not constitute a change in use. Temporary stormwater
storage does not interfere with a requirement that the
property must be open to the public for recreation use. In this
Section, "temporary stormwater storage" means a detention
basin or other system designed to temporarily collect, hold,
and remove stormwater runoff.
Section 10. The Open Space Lands Acquisition and
Development Act is amended by adding Section 15 as follows:
