Bill Title: Creates the Massage Therapist Mandatory Reporting and Domestic Abuse Rehabilitation Act. Defines terms. Provides that a massage therapist who notices suspicious bruising on a recipient of a massage on more than one occasion must report the suspicious bruising to law enforcement as suspected domestic abuse. Provides that law enforcement shall follow up with a suspected victim of domestic abuse to determine whether the suspicious bruising is related to abuse and advise the suspected victim of his or her rights under the Act and other State law. Provides that the suspected victim shall decide whether charges may be brought against the domestic abuser. Provides that the court, after notice and a hearing, shall determine whether a person is a domestic abuser. Provides that a person found to be a domestic abuser is subject to immediate psychiatric evaluation and detainment until the psychiatric evaluation is completed. Provides that the court may order a domestic abuser to participate immediately in inpatient de-escalation skills training before the domestic abuser may return to the household. Makes a corresponding change in the Massage Licensing Act. Effective January 1, 2020.

1 | AN ACT concerning domestic violence.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 1. Short title. This Act may be cited as the | |||||||||||||||||||||
5 | Massage Therapist Mandatory Reporting and Domestic Abuse | |||||||||||||||||||||
6 | Rehabilitation Act.

7 | Section 5. Definitions. As used in this Act: | |||||||||||||||||||||
8 | "Abuse" has the meaning provided in Section 103 of the | |||||||||||||||||||||
9 | Illinois Domestic Violence Act of 1986. | |||||||||||||||||||||
10 | "Domestic abuser" means any person found by a preponderance | |||||||||||||||||||||
11 | of the evidence to have engaged in abuse.

12 | Section 10. Mandatory reporting; domestic abuse | |||||||||||||||||||||
13 | rehabilitation. | |||||||||||||||||||||
14 | (a) A massage therapist who notices suspicious bruising on | |||||||||||||||||||||

18 | (b) Law enforcement shall follow up with a suspected victim | |||||||||||||||||||||

21 | her rights under this Act and other State law. The suspected | |||||||||||||||||||||

2 | (c) The court, after notice and hearing, shall determine | ||||||
3 | whether a person is a domestic abuser. A person found to be a | ||||||
4 | domestic abuser is subject to immediate psychiatric evaluation | ||||||
5 | and detainment until the psychiatric evaluation is completed. A | ||||||
6 | judge may order a domestic abuser to participate immediately in | ||||||
7 | inpatient de-escalation skills training before the domestic | ||||||
8 | abuser may return to the household.

9 | Section 90. The Massage Licensing Act is amended by adding | ||||||
10 | Section 46 as follows:

12 | Sec. 46. Reporting domestic abuse. A massage therapist | ||||||
13 | shall comply with the reporting requirements of Section 10 of | ||||||
14 | the Massage Therapist Mandatory Reporting and Domestic Abuse | ||||||
15 | Rehabilitation Act.

16 | Section 99. Effective date. This Act takes effect January | ||||||
17 | 1, 2020.
