| 1 | AN ACT concerning civil law.

| 2 | Be it enacted by the People of the State of Illinois,

| 3 | represented in the General Assembly:

| 4 | Section 1. Short title. This Act may be cited as the Public | |||||||||||||||||||
| 5 | Duty Rule Codification Act.

| 6 | Section 5. Findings; purpose. | |||||||||||||||||||
| 7 | (a) The General Assembly finds: | |||||||||||||||||||
| 8 | (1) On January 22, 2016, the Illinois Supreme Court, | |||||||||||||||||||
| 9 | in Coleman v. East Joliet Fire Protection District, 2016 | |||||||||||||||||||
| 10 | IL 117952, abolished the public duty rule. | |||||||||||||||||||
| 11 | (2) The public duty rule is an important doctrine that | |||||||||||||||||||
| 12 | is grounded in the principle that the duty of a local | |||||||||||||||||||
| 13 | governmental entity to preserve the well-being of the | |||||||||||||||||||
| 14 | community is owed to the public at large rather than to | |||||||||||||||||||
| 15 | specific members of the community. | |||||||||||||||||||
| 16 | (b) It is the purpose of this Act to codify the public duty | |||||||||||||||||||
| 17 | rule.
