Bill Title: Creates the Retail Sale of Tianeptine Prohibition Act. Provides that beginning January 1, 2026, no person shall sell, offer to sell, or distribute in this State any product containing tianeptine. Provides that the prohibition does not apply to any product containing tianeptine that is lawfully dispensed or prescribed by a pharmacist or a health care professional. Provides that a violation is a business offense, punishable by a minimum fine of $1,500 for each violation. Defines "health care professional". Effective January 1, 2026.

| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly:

| 4 | Section 1. Short title. This Act may be cited as the Retail | |||||||||||||||||||
| 5 | Sale of Tianeptine Prohibition Act.

| 6 | Section 5. Retail sale of tianeptine products. | |||||||||||||||||||
| 7 | (a) Beginning January 1, 2026, no person shall sell, offer | |||||||||||||||||||
| 8 | to sell, or distribute in this State any product containing | |||||||||||||||||||
| 9 | tianeptine. | |||||||||||||||||||
| 10 | (b) This prohibition does not apply to any product | |||||||||||||||||||
| 11 | containing tianeptine that is lawfully dispensed or prescribed | |||||||||||||||||||
| 12 | by a pharmacist or a health care professional. In this | |||||||||||||||||||
| 13 | subsection (b), "health care professional" means any person | |||||||||||||||||||
| 14 | who treats human ailments and is subject to licensure or | |||||||||||||||||||
| 15 | regulation by this State, including students and residents.

| 16 | Section 10. Sentence. A violation of Section 5 is a | |||||||||||||||||||
| 17 | business offense, punishable by a minimum fine of $1,500 for | |||||||||||||||||||
| 18 | each violation.
