Bill Title: Amends the Election Code. Provides that the county clerk shall send a copy of the abstract by precinct or ward and result to the State Board of Elections within 24 hours after receiving the abstract from the election authority.

| 1 | AN ACT concerning elections.
| ||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
| 3 | represented in the General Assembly:
| ||||||||||||||||||||||||
| 4 | Section 5. The Election Code is amended by changing Section | ||||||||||||||||||||||||
| 5 | 22-9 as follows:
| ||||||||||||||||||||||||
| 6 | (10 ILCS 5/22-9) (from Ch. 46, par. 22-9)
| ||||||||||||||||||||||||
| 7 | Sec. 22-9. It shall be the duty of the election authority | ||||||||||||||||||||||||
| 8 | to canvass and add up
and declare the result of every election | ||||||||||||||||||||||||
| 9 | hereafter held within the
boundaries of such city, village or | ||||||||||||||||||||||||
| 10 | incorporated town operating under
Article 6 of this Act. The | ||||||||||||||||||||||||
| 11 | election authority shall file a certified copy of the
record | ||||||||||||||||||||||||
| 12 | with the County Clerk of the county immediately upon completion | ||||||||||||||||||||||||
| 13 | of the record; and
such abstracts or results shall be treated, | ||||||||||||||||||||||||
| 14 | by the County Clerk in all
respects, as if made by the election | ||||||||||||||||||||||||
| 15 | authority now provided by the foregoing
sections of this law, | ||||||||||||||||||||||||
| 16 | and he shall transmit the same, by facsimile, e-mail, or other | ||||||||||||||||||||||||
| 17 | electronic means, to the State Board of
Elections, or other | ||||||||||||||||||||||||
| 18 | proper officer, as required hereinabove.
Within 24 hours after | ||||||||||||||||||||||||
| 19 | receiving the abstract, the The county clerk or board of | ||||||||||||||||||||||||
| 20 | election commissioners, as the case may be,
shall also send the
| ||||||||||||||||||||||||
| 21 | abstract by precinct or ward and result in a sealed envelope | ||||||||||||||||||||||||
| 22 | addressed to the State Board of
Elections via
overnight mail so | ||||||||||||||||||||||||
| 23 | it arrives at the address the following calendar day.
And such

| 1 | abstracts or results so declared, and a certified
copy thereof, | ||||||
| 2 | shall be treated everywhere within the state, and by all
public | ||||||
| 3 | officers, with the same binding force and effect as the | ||||||
| 4 | abstract of
votes now authorized by the foregoing provisions of | ||||||
| 5 | this Act.
