1 | AMENDMENT TO HOUSE BILL 2974

2 | AMENDMENT NO. ______. Amend House Bill 2974 on page 1, | ||||||
3 | immediately below line 3, by inserting the following:
| ||||||
4 | "Section 3. The Illinois Conservation Foundation Act is | ||||||
5 | amended by changing Section 15 as follows:
| ||||||
6 | (20 ILCS 880/15)
| ||||||
7 | Sec. 15. Organization, powers, and duties of Foundation. As | ||||||
8 | soon as
practical after the Foundation is created, the Board of | ||||||
9 | Directors shall meet,
organize, and designate, by majority | ||||||
10 | vote, a treasurer, secretary, and any
additional officers that | ||||||
11 | may be needed to carry out the activities of the
Foundation, | ||||||
12 | and shall adopt bylaws of the Foundation. The Department of
| ||||||
13 | Natural Resources may adopt other rules deemed necessary
to | ||||||
14 | govern Foundation procedures.
| ||||||
15 | The Foundation may accept gifts or grants from the federal | ||||||
16 | government, its
agencies or officers, or from any person, firm, |
| |||||||
| |||||||
1 | or corporation, and may expend
receipts on activities that it | ||||||
2 | considers suitable to the performance of its
duties under this | ||||||
3 | Act and consistent with any requirement of the grant, gift,
or | ||||||
4 | bequest. Funds collected by the Foundation shall be considered
| ||||||
5 | private funds, except those received from public entities, and | ||||||
6 | shall be
held in an appropriate account outside of the State
| ||||||
7 | Treasury.
Private funds collected by the Foundation are not | ||||||
8 | subject to the Public
Funds Investment Act. The Foundation is | ||||||
9 | exempt from the Accountability for the Investment of Public | ||||||
10 | Funds Act. Foundation procurement is exempt from the Illinois
| ||||||
11 | Procurement Code when only private funds are used for | ||||||
12 | procurement
expenditures.
The treasurer of the Foundation | ||||||
13 | shall be custodian of all Foundation
funds. The Foundation's | ||||||
14 | accounts and books shall be set up and maintained in a
manner | ||||||
15 | approved by the Auditor General; and the Foundation and its | ||||||
16 | officers
shall be responsible for the approval of recording of | ||||||
17 | receipts, approval of
payments, and the proper filing of | ||||||
18 | required reports. The Foundation may be
assisted in carrying | ||||||
19 | out its functions by personnel of the
Department of Natural | ||||||
20 | Resources.
The Department shall provide reasonable assistance | ||||||
21 | to the Foundation to
achieve the purposes of the Foundation.

22 | The Foundation shall cooperate fully with the
boards, | ||||||
23 | commissions, agencies, departments, and institutions of the | ||||||
24 | State. The
funds held and made available by the Illinois | ||||||
25 | Conservation Foundation shall be
subject to financial and | ||||||
26 | compliance audits by the Auditor General in compliance
with the |

1 | Illinois State Auditing Act.

2 | The Foundation shall not have any power of eminent domain.

5 | Funds Act is amended by adding Section 12 as follows:

7 | Sec. 12. Exemptions. This Act does not apply to the | ||||||
8 | Illinois Conservation Foundation Act. ".
