Bill Title: Amends the Illinois Governmental Ethics Act. Redefines "lobbying" to include any communication with an official of the executive or legislative branch of any body of government within this State, including, but not limited to, the General Assembly and any unit of local government, for the ultimate purpose of influencing, as that term is defined in the Lobbyist Registration Act, any executive, legislative, or administrative action. Provides that no legislator may engage in lobbying other than in the course of his or her official duties. Increase penalties. Limits home rule powers.

2 | AMENDMENT NO. ______. Amend House Bill 2963 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The State Officials and Employees Ethics Act is | ||||||
5 | amended by adding Section 10-45 as follows:

6 | (5 ILCS 430/10-45 new) | ||||||
7 | Sec. 10-45. Disclosure of gifts accepted by General | ||||||
8 | Assembly members. | ||||||
9 | (a) As soon as practicable after the effective date of this | ||||||
10 | amendatory Act of the 98th General Assembly, the Legislative | ||||||
11 | Ethics Commission shall create a uniform gift disclosure form | ||||||
12 | that each member shall use to disclose any gift that, on or | ||||||
13 | after January 1, 2014, he or she either accepts from a | ||||||
14 | prohibited source based on an exception set forth in Section | ||||||
15 | 10-15 or disposes of in accordance with Section 10-30. For each | ||||||
16 | gift accepted on or after that date from a prohibited source |

1 | based on an exception set forth in Section 10-15, the form | ||||||
2 | shall require the member to: | ||||||
3 | (1) list his or her name; | ||||||
4 | (2) describe in detail the gift received; | ||||||
5 | (3) identify the date on which the gift was received by | ||||||
6 | the member; | ||||||
7 | (4) list the price of the gift or, if the exact price | ||||||
8 | is not known, the fair market value of the gift; | ||||||
9 | (5) include the name, address, and employer of the | ||||||
10 | prohibited source who provided the gift; | ||||||
11 | (6) describe the subject matter of any lobbying | ||||||
12 | activity, as that term is defined in the Lobbyist | ||||||
13 | Registration Act, that occurred in connection with the | ||||||
14 | gift; and | ||||||
15 | (7) state the specific exception or exceptions in | ||||||
16 | Section 10-15 pursuant to which the gift was accepted and | ||||||
17 | why those exceptions bring the member's acceptance of the | ||||||
18 | gift outside the purview of Section 10-10. | ||||||
19 | If a gift is accepted in connection with an educational | ||||||
20 | mission or travel to a meeting to discuss State business, the | ||||||
21 | member shall keep a daily account of each gift accepted in | ||||||
22 | connection with the educational mission or travel and shall | ||||||
23 | report for each gift the information otherwise required under | ||||||
24 | this subsection (a). | ||||||
25 | (b) Beginning January 1, 2014, a member who accepts a gift | ||||||
26 | from a prohibited source pursuant to an exception set forth in |

1 | Section 10-15 or disposes of a gift in accordance with Section | ||||||
2 | 10-30 shall, within 15 days after the receipt of the gift, file | ||||||
3 | a completed gift disclosure form with the appropriate ethics | ||||||
4 | officer. The disclosure form shall be filled in by typewriting | ||||||
5 | or hand printing and shall be verified, dated, and signed by | ||||||
6 | the person making the disclosure. | ||||||
7 | (c) Each ethics officer to whom a disclosure is made | ||||||
8 | pursuant to subsection (a) of this Section shall file with the | ||||||
9 | Legislative Ethics Commission, on dates determined by the | ||||||
10 | Commission, a quarterly report that includes, by member: | ||||||
11 | (1) the total number of gifts that were reported to the | ||||||
12 | officer as being accepted from a prohibited source based on | ||||||
13 | an exception set forth in Section 10-15 during the | ||||||
14 | preceding quarter; | ||||||
15 | (2) the number of gifts reported to the officer as | ||||||
16 | being accepted pursuant to each exception listed in Section | ||||||
17 | 10-15 during the preceding quarter; | ||||||
18 | (3) the total estimated value of all of the gifts | ||||||
19 | reported to the officer as being accepted pursuant to each | ||||||
20 | exception listed in Section 10-15 during the preceding | ||||||
21 | quarter; and | ||||||
22 | (4) the number of gifts reported to the officer as | ||||||
23 | being disposed of in accordance with Section 10-30 during | ||||||
24 | the preceding quarter. | ||||||
25 | Each report filed with the Legislative Ethics Commission | ||||||
26 | pursuant to this subsection (c) shall be made available on the |

2 | Section 99. Effective date. This Act takes effect upon | ||||||
3 | becoming law.".
