Bill Title: Amends the School Code. Provides that, beginning with the 2020-2021 school year, for an elementary school district that is designated by the State Board of Education as having a teacher shortage, each district superintendent shall receive for his or her services an annual salary of $175,000. Provides that an elementary school district may, by referendum approval of the school district's voters, provide a district superintendent a salary of more than $175,000 per year. Provides that if the referendum fails, the school district may not propose another referendum for at least 2 years after the date of the failed referendum.

1 | AN ACT concerning education.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The School Code is amended by changing Section | ||||||||||||||||||||||||||
5 | 10-16.7 and by adding Section 10-16.8 as follows:

7 | Sec. 10-16.7. School board duties with respect to | ||||||||||||||||||||||||||
8 | superintendent. In addition to all other powers and duties | ||||||||||||||||||||||||||
9 | enumerated in this Article, the school board shall make all | ||||||||||||||||||||||||||
10 | employment decisions pertaining to the superintendent , subject | ||||||||||||||||||||||||||
11 | to any salary limitation under Section 10-16.8 . The school | ||||||||||||||||||||||||||
12 | board shall direct, through policy, the superintendent in his | ||||||||||||||||||||||||||
13 | or her charge of the administration of the school district, | ||||||||||||||||||||||||||
14 | including without limitation considering the recommendations | ||||||||||||||||||||||||||
15 | of the superintendent concerning the budget, building plans, | ||||||||||||||||||||||||||
16 | the locations of sites, the selection, retention, and dismissal | ||||||||||||||||||||||||||
17 | of employees, and the selection of textbooks, instructional | ||||||||||||||||||||||||||
18 | material, and courses of study. The school board shall evaluate | ||||||||||||||||||||||||||
19 | the superintendent in his or her administration of school board | ||||||||||||||||||||||||||
20 | policies and his or her stewardship of the assets of the | ||||||||||||||||||||||||||
21 | district.

2 | Sec. 10-16.8. District superintendent; salary. | ||||||
3 | (a) This Section applies only to an elementary school | ||||||
4 | district that is designated by the State Board of Education as | ||||||
5 | having a teacher shortage and, in such a case, only to an | ||||||
6 | employment contract entered into, modified, or renewed on or | ||||||
7 | after the effective date of this amendatory Act of the 101st | ||||||
8 | General Assembly. | ||||||
9 | (b) Beginning with the 2020-2021 school year, a district | ||||||
10 | superintendent shall receive for his or her services an annual | ||||||
11 | salary of $175,000. An elementary school district may, by | ||||||
12 | referendum approval of the school district's voters, provide a | ||||||
13 | district superintendent a salary of more than $175,000 per | ||||||
14 | year. The question of authorizing the school board to provide | ||||||
15 | the district superintendent a salary of more than $175,000 a | ||||||
16 | year must be submitted to the electors of the school district | ||||||
17 | at a regular election and approved by a majority of the | ||||||
18 | electors voting on the question. The school board must certify | ||||||
19 | the question to the proper election authority, which must | ||||||
20 | submit the question at an election in accordance with the | ||||||
21 | Election Code. The election authority must submit the question | ||||||
22 | in substantially the following form: | ||||||
23 | Shall the school board of (name of school district) be | ||||||
24 | authorized to provide the district superintendent a salary | ||||||
25 | of more than $175,000 per year? | ||||||
26 | The election authority must record the votes as "Yes" or "No". |

1 | If a majority of the electors voting on the question vote in | ||||||
2 | the affirmative, the school district may thereafter provide the | ||||||
3 | district superintendent a salary of more than $175,000 per | ||||||
4 | year. If the referendum fails, the school district may not | ||||||
5 | propose another referendum under this Section for at least 2 | ||||||
6 | years after the date of the failed referendum.
