Bill Title: Amends the School Code. Authorizes a school board (or other eligible entity) to hold school or schedule teachers' institutes, parent-teacher conferences, or staff development on certain school holidays if (1) the person or persons honored by the holiday are recognized through instructional activities conducted on that day or, if the day is not used for student attendance, on the first school day preceding or following that day; and (2) the school board or other entity first holds a public hearing about the proposal. Makes other changes. Effective July 1, 2009.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The School Code is amended by adding Sections
5 1B-7.5 and 1B-7.10 as follows:
6 (105 ILCS 5/1B-7.5 new)
7 Sec. 1B-7.5. Hiring of a district superintendent or chief
8 executive officer.
9 (a) Upon expiration of the contract of the school
10 district's superintendent who is serving at the time the
11 Financial Oversight Panel is established, a school district
12 under the authority of a Financial Oversight Panel, after
13 consultation with the Financial Oversight Panel, shall have the
14 authority to appoint a district superintendent with a type 75
15 certificate or a chief executive officer who has the skills of
16 school operations and school finance and who shall have the
17 ultimate responsibility for implementing the policies,
18 procedures, directives, and decisions of the school board and
19 the Financial Oversight Panel.
20 (b) The chief executive officer shall have the authority to
21 determine the agenda and order of business at school board
22 meetings, as needed in order to carry forward and implement the
23 objectives and priorities of the school board and Financial

1 Oversight Panel in the administration and management of the
2 school district.
3 (c) The chief executive officer shall have all of the
4 powers and duties of a school district superintendent under
5 this Code and such other duties as may be assigned by the
6 school board and Financial Oversight Panel, in accordance with
7 this Code. The district shall not thereafter employ a
8 superintendent during the period that a chief executive officer
9 is serving the district.
10 (d) The Financial Oversight Panel shall have the final
11 approval of the superintendent or chief executive officer
12 position under this Section as well as the person, based upon
13 his or her skills to fulfill the position.

15 Sec. 1B-7.10. Hiring of a chief fiscal officer.
16 (a) In lieu of a Financial Oversight Panel Financial
17 Administrator under Section 1B-7 of this Code, a school
18 district under the authority of a Financial Oversight Panel,
19 after consultation with the Financial Oversight Panel, may
20 appoint a chief fiscal officer who, under the direction of the
21 school board and Financial Oversight Panel, shall have the
22 powers and duties of the district's chief school business
23 official and any other duties regarding budgeting, accounting,
24 and other financial matters that are assigned by the school
25 board or Financial Oversight Panel in accordance with this

1 Code. The district may not employ a chief school business
2 official during the period that the chief fiscal officer is
3 serving in the district. The chief fiscal officer may but is
4 not required to hold a certificate with a chief school business
5 official endorsement issued under Article 21 of this Code.
6 (b) The Financial Oversight Panel shall have the final
7 approval of the chief fiscal officer position under this
8 Section as well as the person, based upon his or her skills to
9 fulfill the position.
10 Section 99. Effective date. This Act takes effect upon
11 becoming law.
