Bill Title: Amends the Clerks of Courts Act. Provides that unless an amount or percentage is otherwise provided by statute, for fines, fees, and costs collected and disbursed by the Circuit Court Clerk pursuant to statute, the county board may require the Circuit Court Clerk in its county to retain not less than 1% nor more than 5% for deposit in the Circuit Court Clerk Operation and Administrative Fund. Provides that for funds held in trust by the Circuit Court Clerk pursuant to statute or court order, except for bail bond or child support payment amounts, the county board may require the Circuit Court Clerk in its county to retain not less than 1% nor more than 5% for deposit in the Circuit Court Clerk Operation and Administrative Fund.

705 ILCS 105/27.3d

Amends the Clerks of Courts Act. 1 AN ACT concerning courts.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Clerks of Courts Act is amended by changing
5Section 27.3d as follows:
6 (705 ILCS 105/27.3d)
7 Sec. 27.3d. Circuit Court Clerk Operation and
8Administrative Fund.
9 (a) Each Circuit Court Clerk shall create a Circuit Court
10Clerk Operation and Administrative Fund, to be used to offset
11the costs incurred by the Circuit Court Clerk in performing the
12additional duties required to collect and disburse funds to
13entities of State and local government as provided by law. The
14Circuit Court Clerk shall be the custodian, ex officio, of this
15Fund and shall use the Fund to perform the duties required by
16the office. The Fund shall be audited by the auditor retained
17by the Clerk for the purpose of conducting the Annual Circuit
18Court Clerk Audit. Expenditures shall be made from the Fund by
19the Circuit Court Clerk for expenses related to the cost of
20collection for and disbursement to entities of State and local
21government.
22 (b) Unless an amount or percentage is otherwise provided by
23statute, for fines, fees, and costs collected and disbursed by

1the Circuit Court Clerk pursuant to statute, the county board
2may require the Circuit Court Clerk in its county to retain not
3less than 1% nor more than 5% for deposit in the Circuit Court
4Clerk Operation and Administrative Fund.
5 (c) For funds held in trust by the Circuit Court Clerk
6pursuant to statute or court order, the county board may
7require the Circuit Court Clerk in its county to retain not
8less than 1% nor more than 5% for deposit in the Circuit Court
9Clerk Operation and Administrative Fund. This subsection does
10not include bail bond or child support payment amounts.
