| 2 | AMENDMENT NO. ______. Amend House Bill 2264 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The State Finance Act is amended by adding | ||||||
| 5 | Section 5.786 as follows:
| ||||||
| 6 | (30 ILCS 105/5.786 new) | ||||||
| 7 | Sec. 5.786. The Illinois Patriot Guard Fund.
| ||||||
| 8 | Section 10. The Illinois Vehicle Code is amended by adding | ||||||
| 9 | Section 3-696 as follows:
| ||||||
| 10 | (625 ILCS 5/3-696 new) | ||||||
| 11 | Sec. 3-696. Illinois Patriot Guard plates. | ||||||
| 12 | (a) In addition to any other special license plate, the | ||||||
| 13 | Secretary, upon
receipt of all applicable fees and applications | ||||||
| 14 | made in the form prescribed
by the Secretary of State, may | ||||||

| |||||||
| 1 | issue Illinois Patriot Guard license plates to
residents of | ||||||
| 2 | Illinois who meet eligibility requirements prescribed by the
| ||||||
| 3 | Secretary of State. The special Illinois Patriot Guard plate | ||||||
| 4 | issued under this
Section shall be affixed only to passenger | ||||||
| 5 | vehicles of the first division, motorcycles, and motor vehicles | ||||||
| 6 | of the second division weighing not more than 8,000 pounds. | ||||||
| 7 | Plates issued under this Section shall expire according to the
| ||||||
| 8 | staggered multi-year procedure established by Section 3-414.1 | ||||||
| 9 | of this Code. | ||||||
| 10 | (b) The plates shall display the Illinois Patriot Guard | ||||||
| 11 | emblem. In all other
respects, the design, color, and format of | ||||||
| 12 | the plates shall be within the
discretion of the Secretary of | ||||||
| 13 | State. The Secretary may, in his or her
discretion, allow the | ||||||
| 14 | plates to be issued as vanity or personalized plates in
| ||||||
| 15 | accordance with Section 3-405.1 of this Code. The plates are | ||||||
| 16 | not required to
designate "Land of Lincoln", as prescribed in | ||||||
| 17 | subsection (b) of Section 3-412
of this Code. The Secretary | ||||||
| 18 | shall prescribe the eligibility requirements and,
in his or her | ||||||
| 19 | discretion, shall approve and prescribe stickers or decals as
| ||||||
| 20 | provided under Section 3-412. | ||||||
| 21 | (c) An applicant for the special plate shall be charged a | ||||||
| 22 | $40 fee for original issuance in addition to the appropriate | ||||||
| 23 | registration fee. Of this fee, $25 shall be deposited into the | ||||||
| 24 | Illinois Patriot Guard Fund and $15 shall be deposited into the | ||||||
| 25 | Secretary of State Special License Plate Fund to be used by the | ||||||
| 26 | Secretary to help defray the administrative processing costs. | ||||||

| 1 | For each registration renewal period, a $27 fee, in addition to | ||||||
| 2 | the appropriate registration fee, shall be charged. Of this | ||||||
| 3 | fee, $25 shall be deposited into the Illinois Patriot Guard | ||||||
| 4 | Fund and $2 shall be deposited into the Secretary of State | ||||||
| 5 | Special License Plate Fund. | ||||||
| 6 | (d) The Illinois Patriot Guard Fund is created as a special | ||||||
| 7 | fund in the State treasury. All moneys in the Illinois Patriot | ||||||
| 8 | Guard Fund shall be paid, subject to appropriation by the | ||||||
| 9 | General Assembly and approval by the Secretary, as grants to | ||||||
| 10 | the Illinois Illinois Patriot Guard Riders, a not-for-profit | ||||||
| 11 | corporation, for charitable assistance to Illinois Patriot | ||||||
| 12 | Guard Riders and their missions to the people of Illinois.
| ||||||
| 13 | Section 99. Effective date. This Act takes effect upon | ||||||
| 14 | becoming law.".
