Bill Title: Creates the Toll Exemption for Motorcycles Act. AN ACT concerning transportation.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 1. Short title. This Act may be cited as the Toll
Exemption for Motorcycles Act.
Section 5. Toll exemption for motorcycles.
(a) A State agency or unit of local government may not
collect a toll from a person operating a motorcycle, as defined
in Section 1-147 of the Illinois Vehicle Code, upon any
highway, roadway, bridge, or street in this State.
(b) A home rule unit may not regulate the payment of a toll
on a highway, roadway, bridge, or street by a person operating
a motorcycle. This subsection is a denial and limitation of
home rule powers and functions under subsection (g) of Section
6 of Article VII of the Illinois Constitution.
Section 10. The Illinois Highway Code is amended by adding
Section 9-101.7 as follows:

Sec. 9-101.7. Toll exemption for motorcycles.
Notwithstanding any other provision of law, a person operating
a motorcycle is exempt from paying any toll upon any highway,

roadway, bridge, or street of this State, as provided in the
Toll Exemption for Motorcycles Act.
Section 15. The Toll Highway Act is amended by adding
Section 19.5 as follows:

Sec. 19.5. Toll exemption for motorcycles. Notwithstanding
any other provision of law, a person operating a motorcycle is
exempt from paying any toll upon any highway, roadway, bridge,
or street of this State, as provided in the Toll Exemption for
Motorcycles Act.
Section 20. The Toll Bridge Act is amended by adding
Section 7.1 as follows:

Sec. 7.1. Toll exemption for motorcycles. Notwithstanding
any other provision of law, a person operating a motorcycle is
exempt from paying any toll upon any toll bridge in this State,
as provided in the Toll Exemption for Motorcycles Act.
Section 25. The Public Private Agreements for the Illiana
Expressway Act is amended by adding Section 73 as follows:

Sec. 73. Toll exemption for motorcycles. Notwithstanding
any other provision of law, a person operating a motorcycle is
exempt from paying any toll upon any highway, roadway, bridge,
or street of this State, as provided in the Toll Exemption for
Motorcycles Act.
Section 30. The Public-Private Partnerships for
Transportation Act is amended by adding Section 43 as follows:

Sec. 43. Toll exemption for motorcycles. Notwithstanding
any other provision of law, a person operating a motorcycle is
exempt from paying any toll upon any highway, roadway, bridge,
or street of this State, as provided in the Toll Exemption for
Motorcycles Act.
Section 99. Effective date. This Act takes effect upon
becoming law.
