AN ACT concerning local government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Township Code is amended by adding Section
95-35 as follows:
(60 ILCS 1/95-35 new)
Sec. 95-35. Punitive damages; cap. Any punitive damages
awarded against a township shall be capped at 2 times the
amount awarded to the claimant or $250,000, whichever is
greater.
Section 10. The Illinois Municipal Code is amended by
adding Section 1-4-9 as follows:
(65 ILCS 5/1-4-9 new)
Sec. 1-4-9. Punitive damages; cap. Any punitive damages
awarded against a municipality shall be capped at 2 times the
amount awarded to the claimant or $250,000, whichever is
greater.
