65 ILCS 5/1-4-9 new

Amends the Township Code and the Illinois Municipal Code. Provides that any punitive damages awarded against a township or a municipality shall be capped at 2 times the amount awarded to the claimant or $250,000, whichever is greater.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Township Code is amended by adding Section
595-35 as follows:
6 (60 ILCS 1/95-35 new)
7 Sec. 95-35. Punitive damages; cap. Any punitive damages
8awarded against a township shall be capped at 2 times the
9amount awarded to the claimant or $250,000, whichever is
10greater.
11 Section 10. The Illinois Municipal Code is amended by
12adding Section 1-4-9 as follows:
13 (65 ILCS 5/1-4-9 new)
14 Sec. 1-4-9. Punitive damages; cap. Any punitive damages
15awarded against a municipality shall be capped at 2 times the
16amount awarded to the claimant or $250,000, whichever is
17greater.
