| 2 | AMENDMENT NO. ______. Amend House Bill 1156, AS AMENDED, | ||||||
| 3 | with reference to page and line numbers of House Amendment No. | ||||||
| 4 | 10, on page one, by inserting after line 4 the following:

| 5 | "Section 3. The Firearm Owners Identification Card Act is | ||||||
| 6 | amended by changing Section 13.1 as follows:

| 7 | (430 ILCS 65/13.1) (from Ch. 38, par. 83-13.1)
| ||||||
| 8 | Sec. 13.1. Preemption.
| ||||||
| 9 | (a) The provisions of any ordinance enacted by any | ||||||
| 10 | municipality which
requires registration or imposes greater | ||||||
| 11 | restrictions or limitations on the
acquisition, possession and | ||||||
| 12 | transfer of firearms than are imposed by this
Act, are not | ||||||
| 13 | invalidated or affected by this Act. | ||||||
| 14 | (b) A unit of local government, including a home rule unit, | ||||||
| 15 | may not impose any tax, fee, or other assessment other than the | ||||||
| 16 | normal sales tax rate for goods, on any firearms, firearm | ||||||
| |||||||
| |||||||
| 1 | attachments, or firearm ammunition. The provisions of any | ||||||
| 2 | ordinance or resolution on or after the effective date of this | ||||||
| 3 | amendatory Act of the 98th General Assembly by any county | ||||||
| 4 | government that imposes any tax, fee, or other assessment other | ||||||
| 5 | than the normal sales tax rate for goods are invalid and all | ||||||
| 6 | those existing ordinances and resolutions are void. This | ||||||
| 7 | subsection (b) is a limitation of home rule powers under | ||||||
| 8 | subsection (h) of Section 6 of Article VII of the Illinois | ||||||
| 9 | Constitution.
