| 1 | AN ACT concerning wildlife.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois, | ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. If and only if Senate Bill 44 of the 99th
| ||||||
| 5 | General Assembly becomes law in the form in which it passed | ||||||
| 6 | both houses on May 30, 2015, then the Unmanned Aerial System | ||||||
| 7 | Oversight Task Force Act is amended by changing Section 15 as | ||||||
| 8 | follows:
| ||||||

| 10 | Sec. 15. The Unmanned Aerial System Task Force.
| ||||||
| 11 | (a) There is hereby created the Unmanned Aerial System | ||||||
| 12 | Oversight Task Force to study and make recommendations for the | ||||||
| 13 | operation, usage, and regulation of Unmanned Aerial Systems, | ||||||
| 14 | commonly referred to as "drone" technology, within this State.
| ||||||
| 15 | (b) Within 90 days after the effective date of this Act | ||||||
| 16 | members of the Task Force shall be appointed by the Governor | ||||||
| 17 | and shall consist of one member from each of the following | ||||||
| 18 | agencies or interest groups:
| ||||||
| 19 | (1) a member of the Division of Aeronautics of the | ||||||
| 20 | Department of Transportation, nominated by the Secretary | ||||||
| 21 | of Transportation;
| ||||||
| 22 | (2) a member of the Department of State Police, | ||||||
| 23 | nominated by the Director of State Police;
| ||||||

| 1 | (3) a Conservation Police officer of the Department of | ||||||
| 2 | Natural Resources, nominated by the Director of Natural | ||||||
| 3 | Resources;
| ||||||
| 4 | (4) a member of the Department of Agriculture, | ||||||
| 5 | nominated by the Director of Agriculture;
| ||||||
| 6 | (5) a member of the Department of Commerce and Economic | ||||||
| 7 | Opportunity, nominated by the Director of Commerce and | ||||||
| 8 | Economic Opportunity;
| ||||||
| 9 | (6) a UAS technical commercial representative;
| ||||||
| 10 | (7) a UAS manufacturing industry representative;
| ||||||
| 11 | (8) a person nominated by the Attorney General;
| ||||||
| 12 | (9) a member of the Illinois Conservation Police Lodge, | ||||||
| 13 | nominated by the president of the Lodge;
| ||||||
| 14 | (10) a member of a statewide sportsmen's federation, | ||||||
| 15 | nominated by the president of the federation;
| ||||||
| 16 | (11) a member of a statewide agricultural association, | ||||||
| 17 | nominated by the president of the association; | ||||||
| 18 | (12) a member of a statewide commerce association, | ||||||
| 19 | nominated by the president or executive director of the | ||||||
| 20 | association;
| ||||||
| 21 | (13) a person nominated by an electric utility company | ||||||
| 22 | serving retail customers in this State; | ||||||
| 23 | (14) a member of the Illinois National Guard, nominated | ||||||
| 24 | by the Adjutant General; | ||||||
| 25 | (15) a member of a statewide retail association, | ||||||
| 26 | nominated by the president of the association;
| ||||||

| 1 | (16) a member of a statewide manufacturing trade | ||||||
| 2 | association, nominated by the president or chief executive | ||||||
| 3 | officer of the association; | ||||||
| 4 | (17) a member of a statewide property and casualty | ||||||
| 5 | insurance association, nominated by the president or chief | ||||||
| 6 | executive officer of the association; | ||||||
| 7 | (18) a member of a statewide association representing | ||||||
| 8 | real estate brokers licensed in this State, nominated by | ||||||
| 9 | the president of the association; | ||||||
| 10 | (19) a member of a statewide surveying association, | ||||||
| 11 | nominated by the president of the association;
| ||||||
| 12 | (20) a law enforcement official from a municipality | ||||||
| 13 | with a population of 2 million or more inhabitants, | ||||||
| 14 | nominated by the mayor of the municipality;
| ||||||
| 15 | (21) a law enforcement official from a municipality | ||||||
| 16 | with a population of less than 2 million inhabitants, | ||||||
| 17 | nominated by a statewide police chiefs association; and | ||||||
| 18 | (22) a member of a statewide freight railroad | ||||||
| 19 | association, nominated by the president of the | ||||||
| 20 | association. | ||||||
| 21 | (b-5) Within 90 days after the effective date of this Act, | ||||||
| 22 | 8 members of the Task Force shall also be appointed by the | ||||||
| 23 | General Assembly, with 2 members appointed by the Speaker of | ||||||
| 24 | the House of Representatives and 2 members appointed by the | ||||||
| 25 | Minority Leader of the House of Representatives, and 2 members | ||||||
| 26 | appointed by the President of the Senate and 2 members | ||||||

| |||||||
| 1 | appointed by the Minority Leader of the Senate. | ||||||
| 2 | (c) Nominations to the Task Force must be submitted to the | ||||||
| 3 | Governor within 60 days of the effective date of this Act. The | ||||||
| 4 | Governor shall make the appointments within 30 days after the | ||||||
| 5 | close of nominations. The term of the appointment shall be | ||||||
| 6 | until submission of the report of comprehensive | ||||||
| 7 | recommendations under subsection (g) of this Section. The | ||||||
| 8 | member from the Division of Aeronautics of the Department of | ||||||
| 9 | Transportation shall chair the Task Force and serve as a | ||||||
| 10 | liaison to the Governor and General Assembly. Meetings of the | ||||||
| 11 | Task Force shall be held as necessary to complete the duties of | ||||||
| 12 | the Task Force. Meetings of the Task Force shall be held in the | ||||||
| 13 | central part of the State.
| ||||||
| 14 | (d) The members of the Task Force shall receive no | ||||||
| 15 | compensation for serving as members of the Task Force.
| ||||||
| 16 | (e) The Task Force shall consider commercial and private | ||||||
| 17 | uses of drones, landowner and privacy rights, as well as | ||||||
| 18 | general rules and regulations for safe operation of drones, and | ||||||
| 19 | prepare comprehensive recommendations for the safe and lawful | ||||||
| 20 | operation of UAS in this State.
| ||||||
| 21 | (f) The Department of Transportation shall provide | ||||||
| 22 | administrative support to the Task Force. | ||||||
| 23 | (g) The Task Force shall submit a report with | ||||||
| 24 | recommendations to the Governor and General Assembly no later | ||||||
| 25 | than July 1, 2016.
