Bill Title: Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that for persons who (i) are eligible for Medicaid and are inpatients in a facility licensed under the ID/DD Community Care Act or (ii) are enrolled in the Illinois Home and Community Based Services Medicaid Waiver program for adults with developmental disabilities and reside in a facility licensed under the Community-Integrated Living Arrangements Licensure and Certification Act, in any calendar year in which there is a cost-of-living increase in federal Supplemental Security Income benefits or Social Security benefits, the Department shall increase the total monthly personal needs allowance to such persons by an amount equal to the total amount of the increase in federal Supplemental Security Income benefits or Social Security benefits. As to persons residing in facilities licensed under the Community-Integrated Living Arrangements Licensure and Certification Act, provides that the personal needs allowance shall not be reduced below the rates calculated on January 1, 2013. Effective immediately.

AMENDMENT TO HOUSE BILL 959
2 AMENDMENT NO. ______. Amend House Bill 959 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Public Aid Code is amended by
5adding Sections 5-31 and 5-32 as follows:
6 (305 ILCS 5/5-31 new)
7 Sec. 5-31. Personal needs allowance; ID/DD facility.
8 (a) The Department shall promulgate rules to increase by
9$10 for State fiscal year 2014 the total monthly personal needs
10allowance for persons who are inpatients in a facility licensed
11under the ID/DD Community Care Act for which payments are made
12under this Article throughout a month and who are determined to
13be eligible for medical assistance under this Article. For
14State fiscal years 2015 and beyond, in any calendar year in
15which there is a cost-of-living increase in federal
16Supplemental Security Income benefits or Social Security

1benefits, the Department shall promulgate rules to increase the
2total monthly personal needs allowance by an amount that is at
3least equal to the increase in federal Supplemental Security
4Income benefits or Social Security benefits. Nothing in this
5Section shall prohibit the Department from increasing, by rule,
6for State fiscal years 2015 and beyond, the personal needs
7allowance by an amount that is greater than the cost-of-living
8increase in federal Supplemental Security Income benefits or
9Social Security benefits for that calander year.
10 (b) At no time shall the personal needs allowance for
11persons residing in facilities referenced in this Section be
12reduced below the rates calculated for State fiscal year 2014.

17$10 for State fiscal year 2014 the total monthly personal needs
18allowance for persons who reside in a facility licensed under

21medical assistance under this Article, and who are enrolled in
