| 1 | AN ACT concerning safety.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Firearm Owners Identification Card Act is | ||||||
| 5 | amended by changing Section 13.1 as follows:
| ||||||
| 6 | (430 ILCS 65/13.1) (from Ch. 38, par. 83-13.1)
| ||||||
| 7 | Sec. 13.1.
It shall be unlawful for any unit of local | ||||||
| 8 | government, including a home rule unit of government, to | ||||||
| 9 | require any person to obtain any permit or license, other than | ||||||
| 10 | a Firearm Owner's Identification Card, in order to own or | ||||||
| 11 | posses a firearm for his or her personal use. It is declared to | ||||||
| 12 | be the policy of this State that the regulation of the right to | ||||||
| 13 | own or possess a firearm is an exclusive power and function of | ||||||
| 14 | the State. A home rule unit may not regulate the ownership or | ||||||
| 15 | possession of firearms. This Section is a denial and limitation | ||||||
| 16 | of home rule powers and functions under subsection (h) of | ||||||
| 17 | Section 6 of Article VII of the Illinois Constitution. The | ||||||
| 18 | provisions of any ordinance enacted by any municipality which
| ||||||
| 19 | requires registration or imposes greater restrictions or | ||||||
| 20 | limitations on the
acquisition, possession and transfer of | ||||||
| 21 | firearms than are imposed by this
Act, are not invalidated or | ||||||
| 22 | affected by this Act.
