Bill Title: Amends the Illinois Income Tax Act and the Condominium Property Act. Provides that a condominium unit owners' association that is created on or after the effective date of the amendatory Act must require that all members of its board of managers complete a management training seminar. Provides that a member of a board of managers of such an association is entitled to a credit against his or her Illinois income tax liability in an amount equal to 50% of the cost of that training. Effective immediately.

| ||||||
| 2 | AMENDMENT NO. ______. Amend House Bill 172 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 1. Short Title. This amendatory Act may be known | ||||||
| 5 | as the Emergency Seniors and Youth Budget Relief Act of 2011.
| ||||||
| 6 | Section 5. The Illinois Aeronautics Act is amended by | ||||||
| 7 | adding Section 34c as follows:
| ||||||
| 8 | (620 ILCS 5/34c new) | ||||||
| 9 | Sec. 34c. Baggage Fee Sharing Program. | ||||||
| 10 | (a) In all air navigation facilities located in this State | ||||||
| 11 | that are not owned
or controlled by the federal government, the | ||||||
| 12 | Department shall collect a fee
from any person operating | ||||||
| 13 | aircraft for hire or reward in this State who
charges and | ||||||
| 14 | collects a fee in this State, from any person, for that | ||||||
| 15 | traveling
person to simultaneously transport tangible personal | ||||||
| |||||||
| |||||||
| 1 | property on any civil
aircraft operating in the State's | ||||||
| 2 | airways, subject to the following conditions: | ||||||
| 3 | (1) The shared fee to be collected by the Department | ||||||
| 4 | pursuant to
this Section shall be equal to the rate of | ||||||
| 5 | 12.5% of all fees
charged and collected in this State. | ||||||
| 6 | (2) All shared fees collected by the Department | ||||||
| 7 | pursuant to this Section shall be
disbursed within 60 days | ||||||
| 8 | after receipt as follows: 2% to the county that the
shared | ||||||
| 9 | fee was collected for deposit into the General Corporate | ||||||
| 10 | Fund; 2%
to the Department of Transportation of this State | ||||||
| 11 | for administrative expenses related to the implementation
| ||||||
| 12 | of this Section; 96% to the General Revenue Fund. | ||||||
| 13 | (3) The shared fee to be collected by the Department | ||||||
| 14 | pursuant to
this Section is limited to those fees actually | ||||||
| 15 | collected in air navigation
facilities in this State by | ||||||
| 16 | operators of aircraft for hire or reward from any
person | ||||||
| 17 | physically present in this State. | ||||||
| 18 | (b) Fees charged and collected in this State by air | ||||||
| 19 | schools, flying clubs,
and sport parachutists are exempt from | ||||||
| 20 | the provisions of this Section. | ||||||
| 21 | (c) The Department may promulgate rules that it finds | ||||||
| 22 | appropriate to
implement the Baggage Fee Sharing Program | ||||||
| 23 | created by this Section. | ||||||
| 24 | (d) This Section is repealed on January 1, 2015.

| 25 | Section 10. The Illinois Vehicle Code is amended by | ||||||
| |||||||
| |||||||
| 1 | changing Section 13C-50 as follows:
| ||||||
| 2 | (625 ILCS 5/13C-50) | ||||||
| 3 | Sec. 13C-50. Costs. | ||||||
| 4 | (a) Except as otherwise provided in paragraph (a)(5) or | ||||||
| 5 | (b)(7) of Section 13C-15 or in subsection (c) of this Section, | ||||||
| 6 | no fee shall be charged to motor vehicle owners for obtaining | ||||||
| 7 | inspections required under this Chapter. The Vehicle | ||||||
| 8 | Inspection Fund, which is a fund created in the State treasury | ||||||
| 9 | for the purpose of receiving moneys from the Motor Fuel Tax | ||||||
| 10 | Fund and other sources, shall be used, subject to | ||||||
| 11 | appropriation, for the payment of the costs of the program, | ||||||
| 12 | including reimbursement of those agencies of the State that | ||||||
| 13 | incur expenses in the administration or enforcement of the | ||||||
| 14 | program. The Vehicle Inspection Fund shall continue in | ||||||
| 15 | existence notwithstanding the repeal of Chapter 13B. Any money | ||||||
| 16 | in the Vehicle Inspection Fund on February 1, 2007, shall be | ||||||
| 17 | used for the purposes set forth in this Chapter. | ||||||
| 18 | (b) The Agency may acquire, own, maintain, operate, sell, | ||||||
| 19 | lease and otherwise transfer real and personal property and | ||||||
| 20 | interests in real and personal property for the purpose of | ||||||
| 21 | creating or operating inspection stations and for any other | ||||||
| 22 | purpose relating to the administration of this Chapter, and may | ||||||
| 23 | use money from the Vehicle Inspection Fund for these purposes.
| ||||||
| 24 | (c) Beginning on the effective date of this amendatory Act | ||||||
| 25 | of the 97th General Assembly and through December 31, 2014, a | ||||||
| |||||||
| |||||||
| 1 | $10 fee shall be charged to motor vehicle owners for obtaining | ||||||
| 2 | inspections required under this Chapter and shall be deposited | ||||||
| 3 | into the General Revenue Fund. | ||||||

| 5 | Section 97. Severability. The provisions of this Act are | ||||||
| 6 | severable under Section 1.31 of the Statute on Statutes".
