2 | AMENDMENT NO. ______. Amend Senate Bill 3732 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Department of Children and Family Services | ||||||
5 | Powers Law of the
Civil Administrative Code of Illinois is | ||||||
6 | amended by changing Section 510-200 as follows:
| ||||||
7 | (20 ILCS 510/510-200) (was 20 ILCS 510/65.2)
| ||||||
8 | Sec. 510-200. Police and security force.
| ||||||
9 | (a) The Department has the
power to
appoint, subject to | ||||||
10 | the Personnel Code, persons to be
members of a police and | ||||||
11 | security force. Members of the police and security
force shall | ||||||
12 | be peace officers and as such have all powers possessed by
| ||||||
13 | policemen in cities and sheriffs, including the power to make | ||||||
14 | arrests on
view or on warrants of violations of State statutes | ||||||
15 | or city or county
ordinances. These powers may be exercised | ||||||
16 | statewide , however, be exercised only in counties of
more |

| |||||||
1 | than 500,000 population when required for the protection of | ||||||
2 | Department
properties, interests, and personnel or when | ||||||
3 | specifically
requested by
appropriate State or local law | ||||||
4 | enforcement officials. Members of the police
and security | ||||||
5 | force may not serve and execute civil process.
| ||||||
6 | (b) The Director must authorize to each member of the | ||||||
7 | police and security
force and
to any other employee of the | ||||||
8 | Department exercising the powers of a peace
officer a
distinct | ||||||
9 | badge that, on its face, (i) clearly states that the badge is
| ||||||
10 | authorized
by the
Department and (ii)
contains a unique | ||||||
11 | identifying number. No other badge shall be authorized by
the | ||||||
12 | Department.
| ||||||
13 | (c) DCFS Child Protection Security Force. The DCFS Child | ||||||
14 | Protection Security Force is created within the Department. | ||||||
15 | The Department, in conjunction with the Illinois State Police, | ||||||
16 | shall establish criteria for the hiring of officers, education | ||||||
17 | and training curricula, and protocols for engagement with | ||||||
18 | child protection workers and families. The Department has the | ||||||
19 | authority, with Illinois State Police oversight, to adopt and | ||||||
20 | amend any rules necessary to implement the provisions of this | ||||||
21 | Section. | ||||||
22 | The Security Force shall work in coordination with the | ||||||
23 | Department's Division of Child Protection under the direction | ||||||
24 | of the Deputy Director of the Division of Child Protection. | ||||||
25 | All child protection workers, after an initial investigation, | ||||||
26 | may request Security Force engagement when there is the |

1 | possibility of non-cooperation or violence by the family, | ||||||
2 | relatives of the family, friends, partners, neighbors, or any | ||||||
3 | other persons who seek to disrupt the orderly review, removal, | ||||||
4 | or other action deemed necessary for the protection of the | ||||||
5 | child. | ||||||
