| 5 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
| 6 | changing Section 6-109 as follows: | ||||||
| 7 | (625 ILCS 5/6-109) | ||||||

| 9 | Sec. 6-109. Examination of applicants. | ||||||
| 10 | (a) The Secretary of State shall examine every applicant | ||||||
| 11 | for a driver's license or permit who has not been previously | ||||||
| 12 | licensed as a driver under the laws of this State or any other | ||||||
| 13 | state or country, or any applicant for renewal of such | ||||||
| 14 | driver's license or permit when such license or permit has | ||||||
| 15 | been expired for more than one year. The Secretary of State | ||||||
| 16 | shall, subject to the provisions of paragraph (c), examine | ||||||
| |||||||
| |||||||
| 1 | every licensed driver at least every 8 years, and may examine | ||||||
| 2 | or re-examine any other applicant or licensed driver, provided | ||||||
| 3 | that during the years 1984 through 1991 those drivers issued a | ||||||
| 4 | license for 3 years may be re-examined not less than every 7 | ||||||
| 5 | years or more than every 10 years. | ||||||
| 6 | The Secretary of State shall require the testing of the | ||||||
| 7 | eyesight of any driver's license or permit applicant who has | ||||||
| 8 | not been previously licensed as a driver under the laws of this | ||||||
| 9 | State and shall promulgate rules and regulations to provide | ||||||
| 10 | for the orderly administration of all the provisions of this | ||||||
| 11 | Section. | ||||||
| 12 | The Secretary of State shall include at least one test | ||||||
| 13 | question that concerns the provisions of the Pedestrians with | ||||||
| 14 | Disabilities Safety Act in the question pool used for the | ||||||
| 15 | written portion of the driver's license examination within one | ||||||
| 16 | year after July 22, 2010 (the effective date of Public Act | ||||||
| 17 | 96-1167). | ||||||
| 18 | The Secretary of State shall include, in the question pool | ||||||
| 19 | used for the written portion of the driver's license | ||||||
| 20 | examination, test questions concerning safe driving in the | ||||||
| 21 | presence of bicycles, of which one may be concerning the Dutch | ||||||
| 22 | Reach method as described in Section 2-112. | ||||||
| 23 | The Secretary of State shall include, in the question pool | ||||||
| 24 | used for the written portion of the driver's license | ||||||
| 25 | examination, at least one test question concerning driver | ||||||
| 26 | responsibilities when approaching a stationary emergency | ||||||
| |||||||
| |||||||
| 1 | vehicle as described in Section 11-907. If an applicant gives | ||||||
| 2 | an incorrect response to a test question concerning subsection | ||||||
| 3 | (c) of Section 11-907, Section 11-907.5, or subsection (a-1) | ||||||
| 4 | of Section 11-908, then the Secretary of State shall provide | ||||||
| 5 | the applicant with information concerning those Sections. | ||||||
| 6 | (b) Except as provided for those applicants in paragraph | ||||||
| 7 | (c), such examination shall include a test of the applicant's | ||||||
| 8 | eyesight, his or her ability to read and understand official | ||||||
| 9 | traffic control devices, his or her knowledge of safe driving | ||||||
| 10 | practices and the traffic laws of this State, and may include | ||||||
| 11 | an actual demonstration of the applicant's ability to exercise | ||||||
| 12 | ordinary and reasonable control of the operation of a motor | ||||||
| 13 | vehicle, and such further physical and mental examination as | ||||||
| 14 | the Secretary of State finds necessary to determine the | ||||||
| 15 | applicant's fitness to operate a motor vehicle safely on the | ||||||
| 16 | highways, except the examination of an applicant 75 years of | ||||||
| 17 | age or older or, if the Secretary adopts rules under Section 37 | ||||||
| 18 | of the Secretary of State Act to raise the age requirement for | ||||||
| 19 | actual demonstrations, the examination of an applicant who has | ||||||
| 20 | attained that increased age or is older shall include an | ||||||
| 21 | actual demonstration of the applicant's ability to exercise | ||||||
| 22 | ordinary and reasonable control of the operation of a motor | ||||||
| 23 | vehicle. All portions of written and verbal examinations under | ||||||
| 24 | this Section, excepting where the English language appears on | ||||||
| 25 | facsimiles of road signs, may be given in the Spanish language | ||||||
| 26 | and, at the discretion of the Secretary of State, in any other | ||||||
| |||||||
| |||||||
| 1 | language as well as in English upon request of the examinee. | ||||||
| 2 | Deaf persons who are otherwise qualified are not prohibited | ||||||
| 3 | from being issued a license, other than a commercial driver's | ||||||
| 4 | license, under this Code. The examination to test an | ||||||
| 5 | applicant's ability to read and understand official traffic | ||||||
| 6 | control devices and knowledge of safe driving practices and | ||||||
| 7 | the traffic laws of this State may be administered at a | ||||||
| 8 | Secretary of State facility, remotely via the Internet, or in | ||||||
| 9 | a manner otherwise specified by the Secretary of State by | ||||||
| 10 | administrative rule. | ||||||
| 11 | (c) Re-examination for those applicants who at the time of | ||||||
| 12 | renewing their driver's license possess a driving record | ||||||
| 13 | devoid of any convictions of traffic violations or evidence of | ||||||
| 14 | committing an offense for which mandatory revocation would be | ||||||
| 15 | required upon conviction pursuant to Section 6-205 at the time | ||||||
| 16 | of renewal shall be in a manner prescribed by the Secretary in | ||||||
| 17 | order to determine an applicant's ability to safely operate a | ||||||
| 18 | motor vehicle, except that every applicant for the renewal of | ||||||
| 19 | a driver's license who is 75 years of age or older or, if the | ||||||
| 20 | Secretary adopts rules under Section 37 of the Secretary of | ||||||
| 21 | State Act to raise the age requirement for actual | ||||||
| 22 | demonstrations, every applicant for the renewal of a driver's | ||||||
| 23 | license who has attained that increased age or is older must | ||||||
| 24 | prove, by an actual demonstration, the applicant's ability to | ||||||
| 25 | exercise reasonable care in the safe operation of a motor | ||||||
| 26 | vehicle. | ||||||

| |||||||
| 1 | (d) In the event the applicant is not ineligible under the | ||||||
| 2 | provisions of Section 6-103 to receive a driver's license, the | ||||||
| 3 | Secretary of State shall make provision for giving an | ||||||
| 4 | examination, either in the county where the applicant resides | ||||||
| 5 | or at a place adjacent thereto reasonably convenient to the | ||||||
| 6 | applicant, within not more than 30 days from the date said | ||||||
| 7 | application is received. | ||||||
| 8 | (e) The Secretary of State may adopt rules regarding the | ||||||
| 9 | use of foreign language interpreters during the application | ||||||
| 10 | and examination process. | ||||||

| 14 | Sec. 6-109. Examination of applicants. | ||||||
| 15 | (a) The Secretary of State shall examine every applicant | ||||||
| 16 | for a driver's license or permit who has not been previously | ||||||
| 17 | licensed as a driver under the laws of this State or any other | ||||||
| 18 | state or country, or any applicant for renewal of such | ||||||
| 19 | driver's license or permit when such license or permit has | ||||||
| 20 | been expired for more than one year. The Secretary of State | ||||||
| 21 | shall, subject to the provisions of paragraph (c), examine | ||||||
| 22 | every licensed driver at least every 8 years, and may examine | ||||||
| 23 | or re-examine any other applicant or licensed driver, provided | ||||||
| 24 | that during the years 1984 through 1991 those drivers issued a | ||||||
| 25 | license for 3 years may be re-examined not less than every 7 | ||||||
| |||||||
| |||||||
| 1 | years or more than every 10 years. | ||||||

| 8 | renewing their driver's license possess a driving record | ||||||
| 9 | devoid of any convictions of traffic violations or evidence of | ||||||
| 10 | committing an offense for which mandatory revocation would be | ||||||
| 11 | required upon conviction pursuant to Section 6-205 at the time | ||||||
| 12 | of renewal shall be in a manner prescribed by the Secretary in | ||||||
| 13 | order to determine an applicant's ability to safely operate a | ||||||
| 14 | motor vehicle, except that every applicant for the renewal of | ||||||
| 15 | a driver's license who is 79 years of age or older must renew | ||||||
| 16 | in person, and every applicant for the renewal of a driver's | ||||||
| 17 | license who is 87 years of age or older or who is 75 years of | ||||||
| 18 | age or older and holds a commercial driver's license must | ||||||
| 19 | prove, by an actual demonstration, the applicant's ability to | ||||||
| 20 | exercise reasonable care in the safe operation of a motor | ||||||
| 21 | vehicle. | ||||||
| 22 | (d) In the event the applicant is not ineligible under the | ||||||
| 23 | provisions of Section 6-103 to receive a driver's license, the | ||||||
| 24 | Secretary of State shall make provision for giving an | ||||||
| 25 | examination, either in the county where the applicant resides | ||||||
| 26 | or at a place adjacent thereto reasonably convenient to the | ||||||
| |||||||
| |||||||
| 1 | applicant, within not more than 30 days from the date said | ||||||
| 2 | application is received. | ||||||
| 3 | (e) The Secretary of State may adopt rules regarding the | ||||||
| 4 | use of foreign language interpreters during the application | ||||||
| 5 | and examination process and administration of the | ||||||
| 6 | demonstration of the applicant's ability to exercise ordinary | ||||||
| 7 | and reasonable control of the operation of a motor vehicle by | ||||||
| 8 | driver training schools licensed by the Secretary. | ||||||

| 11 | Section 10. The Cycle Rider Safety Training Act is amended | ||||||
| 12 | by changing Section 2.03a and 4 and by adding Section 2.03b as | ||||||
| 13 | follows: | ||||||
| 14 | (625 ILCS 35/2.03a) | ||||||
| 15 | Sec. 2.03a. Cycle rider safety training course provider | ||||||
| 16 | Rider Safety Training Course Provider. "Cycle rider safety | ||||||
| 17 | training course provider" Rider Safety Training Course | ||||||
| 18 | Provider" and "provider" means a community college, State | ||||||
| 19 | university, State or local government agency, or for-profit or | ||||||
| 20 | nonprofit business entity in good standing and operating in | ||||||
| 21 | the State that is capable of providing courses meeting the | ||||||
| 22 | definition in this Act in accordance with the rules set forth | ||||||
| 23 | by the Department and the regulations of this Act. "Cycle | ||||||
| 24 | rider safety training course provider" Rider Safety Training | ||||||
| |||||||
| |||||||
| 1 | Course Provider" and "provider" does not include any business | ||||||
| 2 | registered as a motorcycle dealer with the Secretary of State | ||||||
| 3 | or any other business that derives income from the selling of | ||||||
| 4 | motorcycles or has motorcycles for sale at its place of | ||||||
| 5 | business on a consignment basis. | ||||||

| 8 | Sec. 2.03b. Dealer provider. "Dealer provider" means any | ||||||
| 9 | business registered as a motorcycle dealer holding a vehicle | ||||||
| 10 | dealer license with the Secretary of State and who has applied | ||||||
| 11 | and obtained a permit from the Department to operate as a | ||||||
| 12 | dealer provider. | ||||||

| 14 | Sec. 4. Cycle rider safety training courses Rider Safety | ||||||
| 15 | Training Courses. | ||||||
| 16 | (a) The Department shall, on an as needed basis, put out | ||||||
| 17 | notices to the public seeking cycle rider safety training | ||||||
| 18 | course providers Cycle Rider Safety Training Course Providers | ||||||
| 19 | to provide cycle rider safety training courses in this State. | ||||||
| 20 | Such courses shall be open to all residents of the State who | ||||||
| 21 | hold a currently valid driver's license and who have reached | ||||||
| 22 | their 16th birthday before the first day of the course to be | ||||||
| 23 | held. Such courses may be offered throughout the calendar | ||||||
| 24 | year. | ||||||
| |||||||
| |||||||
| 1 | Cycle rider safety training course providers Providers may | ||||||
| 2 | charge a nominal registration fee set by the Department, which | ||||||
| 3 | shall be refunded upon completion of the course. | ||||||
| 4 | Responses from potential cycle rider safety training | ||||||
| 5 | course providers shall include, at a minimum, the location | ||||||
| 6 | where classes are to be held at, the number of students they | ||||||
| 7 | intend to train, whether they would be providing motorcycles | ||||||
| 8 | or using motorcycles provided by the program, and the cost for | ||||||
| 9 | courses provided on a per student basis. | ||||||
| 10 | Contracts shall be awarded by the Department to cycle | ||||||
| 11 | rider safety training course providers based on training needs | ||||||
| 12 | and cost effectiveness of each bid or proposal as well as the | ||||||
| 13 | provider's organizational capacity to satisfactorily discharge | ||||||
| 14 | cycle rider safety training courses Cycle Rider Safety | ||||||
| 15 | Training Courses. | ||||||
| 16 | (b) A cycle rider safety training course provider shall | ||||||
| 17 | only be paid grant funds under one of the following | ||||||
| 18 | conditions: | ||||||
| 19 | (1) a course was held, in which case the cycle rider | ||||||
| 20 | safety training course provider shall be paid per student | ||||||
| 21 | rate multiplied by the number of students present on the | ||||||
| 22 | first day of the course; | ||||||
| 23 | (2) expenses submitted related to the maintenance of | ||||||
| 24 | program equipment; or | ||||||
| 25 | (3) submitting other non-personnel expenses as deemed | ||||||
| 26 | appropriate by the Department. | ||||||
| |||||||
| |||||||
| 1 | (c) A cycle rider safety training course provider awarded | ||||||
| 2 | a contract with grant funding under this Act shall: | ||||||
| 3 | (1) submit proof to the Department that each | ||||||
| 4 | instructor employed by the cycle rider safety training | ||||||
| 5 | course provider meets the qualifications to teach the | ||||||
| 6 | curriculum for the courses; | ||||||
| 7 | (2) have at least one employee on staff certified to | ||||||
| 8 | do quality assurance or quality control visits where | ||||||
| 9 | instructors are evaluated per curriculum standards on | ||||||
| 10 | teaching; | ||||||
| 11 | (3) perform at least one quality assurance or quality | ||||||
| 12 | control visit on each instructor employed during the year | ||||||
| 13 | and submit the results of those visits to the Department; | ||||||
| 14 | (4) maintain appropriate liability insurance to cover | ||||||
| 15 | training activities; | ||||||
| 16 | (5) submit requests for payment in a timely manner; | ||||||
| 17 | and | ||||||
| 18 | (6) adhere to additional program rules and regulations | ||||||
| 19 | as determined by the Department. | ||||||
| 20 | (d) A cycle rider safety training course provider awarded | ||||||
| 21 | a contract with grant funding under this Act and a dealer | ||||||
| 22 | provider operating under subsection (e) shall not adopt any | ||||||
| 23 | policy, requirement, or expectation regarding an employee's | ||||||
| 24 | manner of dress outside of the employee's scheduled work | ||||||
| 25 | hours, nor may the provider pose any questions regarding such | ||||||
| 26 | on job applications or during interviews with potential | ||||||
| |||||||
| |||||||
| 1 | employees. | ||||||
| 2 | (e) A dealer provider may provide courses under this Act | ||||||
| 3 | to the public for a fee which shall not be refunded. Such | ||||||
| 4 | courses shall be open to all residents of the State who hold a | ||||||
| 5 | currently valid driver's license and who have reached their | ||||||
| 6 | 16th birthday before the first day of the course to be held. | ||||||
| 7 | Such courses may be offered throughout the calendar year. | ||||||
| 8 | A dealer provider is ineligible for funds from the Cycle | ||||||
| 9 | Rider Safety Training Fund as described in subsection (b). A | ||||||
| 10 | dealer provider is not eligible for program funds or equipment | ||||||
| 11 | supplied by the Department. | ||||||
| 12 | A dealer provider offering courses under this subsection: | ||||||
| 13 | (1) shall submit proof to the Department that each | ||||||
| 14 | instructor employed by the dealer provider meets the | ||||||
| 15 | qualifications to teach the curriculum for the courses; | ||||||
| 16 | (2) shall have at least one employee on staff | ||||||
| 17 | certified to do quality assurance or quality control | ||||||
| 18 | visits where instructors are evaluated per curriculum | ||||||
| 19 | standards on teaching; | ||||||
| 20 | (3) shall perform at least one quality assurance or | ||||||
| 21 | quality control visit on each instructor employed during | ||||||
| 22 | the year and submit the results of those visits to the | ||||||
| 23 | Department; | ||||||
| 24 | (4) shall maintain appropriate liability insurance to | ||||||
| 25 | cover training activities; | ||||||
| 26 | (5) shall run its program according to a curriculum | ||||||
| |||||||
| |||||||
| 1 | approved by the Department; | ||||||
| 2 | (6) shall adhere to additional program rules and | ||||||
| 3 | regulations as determined by the Department. | ||||||
| 4 | (7) shall not engage in sales solicitation of its | ||||||
| 5 | retail products to students during the registration | ||||||
| 6 | process or on the same day that the student is attending a | ||||||
| 7 | cycle rider safety training course; and | ||||||
| 8 | (8) shall place a cycle rider safety training provider | ||||||
| 9 | promotional sign in any dealership alongside material | ||||||
| 10 | advertising its dealer provider classes. | ||||||
| 11 | If the Department finds that a dealer provider is not | ||||||
| 12 | meeting the requirements of this Section in a satisfactory | ||||||
| 13 | way, the Department is authorized to suspend or terminate the | ||||||
| 14 | ability of the dealer provider to issue student completion | ||||||
| 15 | cards. | ||||||

| 17 | Section 95. No acceleration or delay. Where this Act makes | ||||||
| 18 | changes in a statute that is represented in this Act by text | ||||||
| 19 | that is not yet or no longer in effect (for example, a Section | ||||||
| 20 | represented by multiple versions), the use of that text does | ||||||
| 21 | not accelerate or delay the taking effect of (i) the changes | ||||||
| 22 | made by this Act or (ii) provisions derived from any other | ||||||
| 23 | Public Act. | ||||||
| 24 | Section 99. Effective date. This Act takes effect January | ||||||
