| 1 | AMENDMENT TO SENATE BILL 3208 | ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 3208 by replacing | ||||||
| 3 | everything after the enacting clause with the following: | ||||||
| 4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
| 5 | changing Sections 1-130 and 15-312 as follows: | ||||||
| 6 | (625 ILCS 5/1-130) (from Ch. 95 1/2, par. 1-130) | ||||||
| 7 | Sec. 1-130. Implement of husbandry. Every vehicle designed | ||||||
| 8 | and adapted exclusively for agricultural, horticultural, or | ||||||
| 9 | livestock-raising livestock raising operations, including farm | ||||||
| 10 | wagons, wagon trailers, or similar or like vehicles used in | ||||||
| 11 | connection with such operations therewith, or for lifting or | ||||||
| 12 | carrying an implement of husbandry; however, the term does not | ||||||
| 13 | include any provided that no farm wagon, wagon trailer, or | ||||||
| 14 | similar or like vehicle with only one axle having a gross | ||||||
| 15 | weight of more than 36,000 pounds or any farm wagon, wagon | ||||||
| 16 | trailer, or similar vehicle with 2 or more axles having a gross | ||||||

| 1 | weight of more than 52,000 pounds , shall be included | ||||||
| 2 | hereunder. | ||||||

| 5 | Sec. 15-312. Fees for police escort. When State Police | ||||||
| 6 | escorts are required by the Department of Transportation for | ||||||
| 7 | the safety of the motoring public, the following fees shall be | ||||||
| 8 | paid by the applicant: | ||||||
| 9 | (1) to the Department of Transportation: $40 per hour | ||||||
| 10 | per vehicle based upon the pre-estimated time of the | ||||||
| 11 | movement to be agreed upon between the Department and the | ||||||
| 12 | applicant, with a minimum fee of $80 per vehicle; and | ||||||
| 13 | (2) to the Illinois State Police: $125 $75 per hour | ||||||
| 14 | per State Police vehicle based upon the actual time of the | ||||||
| 15 | movement, with a minimum fee of $500 $300 per State Police | ||||||
| 16 | vehicle. The Illinois State Police shall remit the moneys | ||||||
| 17 | to the State Treasurer, who shall deposit the moneys into | ||||||
| 18 | the State Police Operations Assistance Fund. | ||||||
| 19 | The actual time of the movement shall be the time the | ||||||
| 20 | police escort is required to pick up the movement to the time | ||||||
| 21 | the movement is completed. Any delays or breakdowns shall be | ||||||
| 22 | considered part of the movement time. Any fraction of an hour | ||||||
| 23 | shall be rounded up to the next whole hour. | ||||||
| 24 | The State Police may use an online payment system to | ||||||
| 25 | accept fees for police escorts. | ||||||
