| 2 | AMENDMENT NO. ______. Amend Senate Bill 3048 by replacing | ||||||

| 4 | "Section 5. The Freedom of Information Act is amended by | ||||||
| 5 | changing Section 7.5 as follows: | ||||||

| 13 | under Section 4002 of the Technology Advancement and | ||||||
| 14 | Development Act. | ||||||
| 15 | (b) Library circulation and order records identifying | ||||||
| 16 | library users with specific materials under the Library | ||||||

| |||||||
| 1 | Records Confidentiality Act. | ||||||
| 2 | (c) Applications, related documents, and medical | ||||||
| 3 | records received by the Experimental Organ Transplantation | ||||||
| 4 | Procedures Board and any and all documents or other | ||||||
| 5 | records prepared by the Experimental Organ Transplantation | ||||||
| 6 | Procedures Board or its staff relating to applications it | ||||||
| 7 | has received. | ||||||
| 8 | (d) Information and records held by the Department of | ||||||
| 9 | Public Health and its authorized representatives relating | ||||||
| 10 | to known or suspected cases of sexually transmitted | ||||||
| 11 | infection or any information the disclosure of which is | ||||||
| 12 | restricted under the Illinois Sexually Transmitted | ||||||
| 13 | Infection Control Act. | ||||||
| 14 | (e) Information the disclosure of which is exempted | ||||||
| 15 | under Section 30 of the Radon Industry Licensing Act. | ||||||
| 16 | (f) Firm performance evaluations under Section 55 of | ||||||
| 17 | the Architectural, Engineering, and Land Surveying | ||||||
| 18 | Qualifications Based Selection Act. | ||||||
| 19 | (g) Information the disclosure of which is restricted | ||||||
| 20 | and exempted under Section 50 of the Illinois Prepaid | ||||||
| 21 | Tuition Act. | ||||||
| 22 | (h) Information the disclosure of which is exempted | ||||||
| 23 | under the State Officials and Employees Ethics Act, and | ||||||
| 24 | records of any lawfully created State or local inspector | ||||||
| 25 | general's office that would be exempt if created or | ||||||
| 26 | obtained by an Executive Inspector General's office under | ||||||
| |||||||
| |||||||
| 1 | that Act. | ||||||
| 2 | (i) Information contained in a local emergency energy | ||||||
| 3 | plan submitted to a municipality in accordance with a | ||||||
| 4 | local emergency energy plan ordinance that is adopted | ||||||
| 5 | under Section 11-21.5-5 of the Illinois Municipal Code. | ||||||
| 6 | (j) Information and data concerning the distribution | ||||||
| 7 | of surcharge moneys collected and remitted by carriers | ||||||
| 8 | under the Emergency Telephone System Act. | ||||||
| 9 | (k) Law enforcement officer identification information | ||||||
| 10 | or driver identification information compiled by a law | ||||||
| 11 | enforcement agency or the Department of Transportation | ||||||
| 12 | under Section 11-212 of the Illinois Vehicle Code. | ||||||
| 13 | (l) Records and information provided to a residential | ||||||
| 14 | health care facility resident sexual assault and death | ||||||
| 15 | review team or the Executive Council under the Abuse | ||||||
| 16 | Prevention Review Team Act. | ||||||
| 17 | (m) Information provided to the predatory lending | ||||||
| 18 | database created pursuant to Article 3 of the Residential | ||||||
| 19 | Real Property Disclosure Act, except to the extent | ||||||
| 20 | authorized under that Article. | ||||||
| 21 | (n) Defense budgets and petitions for certification of | ||||||
| 22 | compensation and expenses for court appointed trial | ||||||
| 23 | counsel as provided under Sections 10 and 15 of the | ||||||
| 24 | Capital Crimes Litigation Act (repealed). This subsection | ||||||
| 25 | (n) shall apply until the conclusion of the trial of the | ||||||
| 26 | case, even if the prosecution chooses not to pursue the | ||||||

| 15 | (q) Information prohibited from being disclosed by the | ||||||
| 16 | Personnel Record Review Act. | ||||||
| 17 | (r) Information prohibited from being disclosed by the | ||||||
| 18 | Illinois School Student Records Act. | ||||||
| 19 | (s) Information the disclosure of which is restricted | ||||||
| 20 | under Section 5-108 of the Public Utilities Act. | ||||||
| 21 | (t) (Blank). | ||||||
| 22 | (u) Records and information provided to an independent | ||||||
| 23 | team of experts under the Developmental Disability and | ||||||
| 24 | Mental Health Safety Act (also known as Brian's Law). | ||||||
| 25 | (v) Names and information of people who have applied | ||||||
| 26 | for or received Firearm Owner's Identification Cards under | ||||||

| 19 | Sec. 301.1. Law enforcement policies. | ||||||
| 20 | (a) Every law enforcement agency shall develop, adopt, and | ||||||
| 21 | implement written policies regarding arrest procedures for | ||||||
| 22 | domestic violence incidents consistent with the provisions of | ||||||
| 23 | this Act. In developing these policies, each law enforcement | ||||||
| 24 | agency shall consult with community organizations and other | ||||||
| |||||||
| |||||||
| 1 | law enforcement agencies with expertise in recognizing and | ||||||
| 2 | handling domestic violence incidents. | ||||||
| 3 | (b) In the initial training of new recruits and every 5 | ||||||
| 4 | years in the continuing education of law enforcement officers, | ||||||
| 5 | every law enforcement agency shall provide training to aid in | ||||||
| 6 | understanding the actions of domestic violence victims and | ||||||
| 7 | abusers and to prevent further victimization of those who have | ||||||
| 8 | been abused, focusing specifically on looking beyond the | ||||||
| 9 | physical evidence to the psychology of domestic violence | ||||||
| 10 | situations, such as the dynamics of the aggressor-victim | ||||||
| 11 | relationship, separately evaluating claims where both parties | ||||||
| 12 | claim to be the victim, and long-term effects. | ||||||
| 13 | Beginning January 1, 2029, for law enforcement agencies | ||||||
| 14 | using lethality assessments, the continuing education should | ||||||
| 15 | include training on policies and procedures for administering | ||||||
| 16 | a lethality assessment. | ||||||
| 17 | The Law Enforcement Training Standards Board shall | ||||||
| 18 | formulate and administer the training under this subsection | ||||||
| 19 | (b) as part of the current programs for both new recruits and | ||||||
| 20 | active law enforcement officers. The Board shall formulate the | ||||||
| 21 | training by July 1, 2017, and implement the training statewide | ||||||
| 22 | by July 1, 2018. In formulating the training, the Board shall | ||||||
| 23 | work with community organizations with expertise in domestic | ||||||
| 24 | violence to determine which topics to include. The Law | ||||||
| 25 | Enforcement Training Standards Board shall oversee the | ||||||
| 26 | implementation and continual administration of the training. | ||||||

| 3 | Sec. 307. Domestic violence lethality assessments. By | ||||||
| 4 | January 1, 2028, the Department of Human Services, in | ||||||
| 5 | cooperation with the Illinois State Police, shall create a | ||||||
| 6 | domestic violence lethality tool kit for use by law | ||||||
| 7 | enforcement agencies. As part of this effort, the Illinois | ||||||
| 8 | State Police and Department may engage with groups, including, | ||||||
| 9 | but not limited to, a statewide association representing | ||||||
| 10 | sheriffs, a statewide association representing chiefs of | ||||||
| 11 | police, a statewide association representing State's | ||||||
| 12 | Attorneys, a statewide association dedicated to domestic | ||||||
| 13 | violence prevention that includes survivor voices, and an | ||||||
| 14 | association working with victims' rights to review and provide | ||||||
| 15 | feedback on a template. Stakeholder feedback shall be gathered | ||||||
| 16 | and analyzed by August 1, 2027. Based on this feedback, model | ||||||
| 17 | policies and protocols shall be developed that law enforcement | ||||||
| 18 | agencies may use or reference in developing their domestic | ||||||
| 19 | violence lethality assessment template, policies, protocols, | ||||||
| 20 | training, and referrals to domestic violence services. Nothing | ||||||
| 21 | in this Section imposes any additional liability on a law | ||||||
| 22 | enforcement officer or agency acting in good faith | ||||||
| 23 | administering these assessments. | ||||||
| 24 | Section 95. No acceleration or delay. Where this Act makes | ||||||
| |||||||
| |||||||
| 1 | changes in a statute that is represented in this Act by text | ||||||
| 2 | that is not yet or no longer in effect (for example, a Section | ||||||
| 3 | represented by multiple versions), the use of that text does | ||||||
| 4 | not accelerate or delay the taking effect of (i) the changes | ||||||
| 5 | made by this Act or (ii) provisions derived from any other | ||||||
