AMENDMENT TO SENATE BILL 2891
2 AMENDMENT NO. ______. Amend Senate Bill 2891 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Insurance Code is amended by
5adding Section 356z.43 as follows:
6 (215 ILCS 5/356z.43 new)
7 Sec. 356z.43. Prescription drug coverage.
8 (a) Except as provided in subsection (b), an insurer shall
9only offer a group or individual policy of accident and health
10insurance that:
11 (1) does not require a covered individual to pay a
12 deductible for covered prescription drugs; and
13 (2) provides that the cost-sharing requirement for a
14 covered individual for any given prescription drug may not
15 exceed the amount of the copayment or coinsurance specified
16 in the policy's summary of benefits and coverage.

1 (b) The requirements imposed under subsection (a) do not
2apply to any high deductible health plan, as defined by Section
3223 of the Internal Revenue Code. High deductible health plans
4described in this subsection may not impose a deductible
5requirement with respect to any preventative care identified by
6the Internal Revenue Service in accordance with Section
7223(c)(2)(C) of the Internal Revenue Code.
8 Section 99. Effective date. This Act takes effect January
91, 2021.".
