AMENDMENT TO SENATE BILL 2891
AMENDMENT NO. ______. Amend Senate Bill 2891 by replacing
everything after the enacting clause with the following:
"Section 5. The Illinois Insurance Code is amended by
adding Section 356z.43 as follows:
(215 ILCS 5/356z.43 new)
Sec. 356z.43. Prescription drug coverage.
(a) Except as provided in subsection (b), an insurer shall
only offer a group or individual policy of accident and health
insurance that:
(1) does not require a covered individual to pay a
deductible for covered prescription drugs; and
(2) provides that the cost-sharing requirement for a
covered individual for any given prescription drug may not
exceed the amount of the copayment or coinsurance specified
in the policy's summary of benefits and coverage.

(b) The requirements imposed under subsection (a) do not
apply to any high deductible health plan, as defined by Section
223 of the Internal Revenue Code. High deductible health plans
described in this subsection may not impose a deductible
requirement with respect to any preventative care identified by
the Internal Revenue Service in accordance with Section
223(c)(2)(C) of the Internal Revenue Code.
Section 99. Effective date. This Act takes effect January
1, 2021.".
