| 1 | AMENDMENT TO SENATE BILL 2803
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 2803 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
| 5 | changing Section 11-500 as follows:
| ||||||
| 6 | (625 ILCS 5/11-500) (from Ch. 95 1/2, par. 11-500)
| ||||||
| 7 | Sec. 11-500. Definitions. For the purposes of interpreting | ||||||
| 8 | Sections
6-206.1 and 6-208.1 of this Code, "first offender" | ||||||
| 9 | shall mean any person
who has not had a previous conviction or | ||||||
| 10 | court assigned supervision for
violating Section 11-501, or a | ||||||
| 11 | similar provision of a local ordinance,
or a conviction in any | ||||||
| 12 | other state for a violation of driving while under
the | ||||||
| 13 | influence or a similar offense where the cause of action is the | ||||||
| 14 | same
or substantially similar to this Code or similar offenses | ||||||
| 15 | committed on a military installation, or any person who has not | ||||||
| 16 | had a driver's license suspension pursuant to paragraph 6 of | ||||||
| |||||||
| |||||||
| 1 | subsection (a) of Section 6-206 as the result of refusal of | ||||||
| 2 | chemical testing in another state, or any
person who has not | ||||||
| 3 | had a driver's license
suspension or revocation for violating | ||||||
| 4 | Section 11-501.1 within 15 5 years prior to the date of
the
| ||||||
| 5 | current offense, except in cases where the driver submitted to
| ||||||
| 6 | chemical testing resulting in an alcohol concentration of 0.08 | ||||||
| 7 | or
more,
or any amount of a drug, substance, or compound in | ||||||
| 8 | such person's blood, other bodily substance, or
urine resulting | ||||||
| 9 | from the unlawful use or consumption of cannabis listed in
the | ||||||
| 10 | Cannabis Control Act, a controlled substance listed in the
| ||||||
| 11 | Illinois
Controlled Substances Act, or an intoxicating | ||||||
| 12 | compound listed in the Use
of
Intoxicating Compounds Act, or | ||||||
| 13 | methamphetamine as listed in the Methamphetamine Control and | ||||||
| 14 | Community Protection Act and
was subsequently found not guilty | ||||||
| 15 | of violating Section 11-501, or a similar
provision of a local | ||||||
| 16 | ordinance. | ||||||
