| 1 | AMENDMENT TO SENATE BILL 2233

| 2 | AMENDMENT NO. ______. Amend Senate Bill 2233 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Local Records Act is amended by adding | ||||||
| 5 | Section 25 as follows:
| ||||||
| 6 | (50 ILCS 205/25 new) | ||||||
| 7 | Sec. 25. Police misconduct records. All records related to | ||||||
| 8 | complaints, investigations, and adjudications of police | ||||||
| 9 | misconduct shall be permanently retained and may not be | ||||||
| 10 | destroyed. This Section applies to all applicable records | ||||||
| 11 | currently in existence or created in the future, and this | ||||||
| 12 | Section expressly overrides any agreement or order to destroy | ||||||
| 13 | these records.
| ||||||
| 14 | Section 99. Effective date. This Act takes effect upon | ||||||
| 15 | becoming law.".
